Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Solicitation number W5K9FH-11-T-0102 is issued as an RFQ. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-48, Department of Defense Federal Acquisition Regulation Supplement (DFARS) current to DPN 20110112, Army Federal Acquisition Regulation Supplement (AFARS) Revision #25 dated April 1, 2010, and CENTCOM Contracting Command Acquisition Instruction dated November 5, 2010. The Regional Contracting Center aboard Camp Leatherneck, Afghanistan, has a requirement for: Line Item 0001: Vackson VK6000 Light Tower. Qty: 40. Unit of Issue: EA. Delivery Address: Camp Leatherneck, Afghanistan FPO AP 96427-2174. Required Delivery Date: 30 days after contract award. FOB: Destination. This is a Brand Name or Equal RFQ. Vendors are encouraged to quote products that are equal to the Brand Name requested. To be considered equal, a product must meet the following salient characteristics: 4 X 1000 watts Metal Halide fixtures, w/ generator that uses JP-8 or Diesel, extendable shaft at minimum of 18 ft, easily moveable and can withstand extreme weather. The provision at FAR 52.212-1, Instructions to Offerors - Commercial, applies to this acquisition. The Government will award a contract resulting from this solicitation, using the procedures at FAR part 13 Simplified Acquisition Procedures, to the technically acceptable quote with the lowest evaluated price (Lowest Price Technically Acceptable). To be considered technically acceptable, a quote must be submitted by a responsible vendor - must not be in Excluded Parties List System and have satisfactory Past Performance - and include the following information: unit price, total price, shipping costs (items must be shipped directly to Camp Leatherneck, Afghanistan), delivery time, and enough product information to determine if product is equal (if not quoting Brand Name). Vendors must also include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications - Commercial Items, with their quote, or a statement that the information at https://orca.bpn.gov is up to date. The following FAR clauses apply to this acquisition: 52.211-6, Brand Name or Equal; 52.212-4, Contract Terms and Conditions - Commercial Items; 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items; 52.203-3, Gratuities; 52.209-6 Protecting the Government's Interest When Subcontracting With Contractors Debarred, Suspended, or Proposed for Debarment; 52.203-6, Restrictions on Subcontractor Sales to the Government; 52.204-10, Reporting Executive Compensation and First-Tier Subcontract Awards; 52.222-19, Child Labor - Cooperation with Authorities and Remedies; 52.225-13, Restrictions on Certain Foreign Purchases; 52.232-34, Payment by Electronic Funds Transfer - Other than Central Contractor Registration; 52.233-2 Service of Protest. The following DFARS clauses apply to this acquisition: 252.203-7002, Requirement to Inform Employees of Whistleblower Rights; 252.232-7008, Assignment of Claims (Overseas); 252.232-7010, Levies on Contract Payments; 252.233-7001, Choice of Law (Overseas); 252.212-7001, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Applicable to Defense Acquisitions of Commercial Items; 252.203-7000, Requirements Relating to Compensation of Former DoD Officials; and 252.247-7023, Transportation of Supplies by Sea. The following C3 clauses apply to this acquisition: 952.201-0001 Ombudsman; 952.225-0015, Subcontracting Requirements; 952.232-0002, Notice of Payment in Local Currency (Afghanistan); and 952.233-0001, C3 Agency Protest Program. To be considered, quotes must be submitted no later than Monday, January 24, 2011 at 11:59 PM EST (GMT - 4:00).
