- NOTICE OF INTENT VA Maryland Health Care System (VAMHCS) Contracting Office, Baltimore, Maryland intends to award a sole source fixed-price service for the acquisition of a certified and trained engineer to perform scheduled Planned Maintenance (PM) and unscheduled repairs on Agency's existing trademarked Sterrad systems. The proposed contract action is for services for which the Government intends to solicit and negotiate sole award under authority of FAR Part 6.302-1, Only one responsible source and no other supplies or services will satisfy agency's requirements and 41 U.S.C. 253(c)(1). This notice of intent is not a request for competitive quotes or proposals. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION PURCHASE REQUEST: 792-11-1-129-0006 1. Contracting Activity: VA Capitol Health Care Network (VISN 5), Contracting Division, 10 North Greene Street, Maryland 21201. Services: The Department of Veterans Affairs, VA Maryland Health Care System (VAMHCS), VISN 5 Contracting Office proposes to enter into a contract on the basis of other than full and open competition for the Department of Veterans Affairs, Facilities and Engineering (138), 10 North Greene Street, Baltimore, MD 21201. 2. Description of Action: The Justification for the use of Other Than Full and Open Competition (JOFOC) is contained in FAR 6.302-1. In effect, a Sole Source Firm-Fixed Price Service Contract is being requested by Facilities and Engineering (138), Sterilization Processing Decontamination (SPD). VAMHCS Contracting intends to negotiate and award a Sole source service contract to Advanced Sterilization Products (ASP), a company currently used and also servicing agent in the Baltimore VA Medical Center (VAMC) system. 3. Description of Supplies/Services: This requirement is for the acquisition to acquire a trained and certified engineer to perform scheduled planned maintenance (PM) and unscheduled repairs on Agency s existing trademarked STERRAD systems. It also requires the provision of personnel, management, material, parts, equipment, supplies, labor and transportation. Equipment, parts, and maintenance/technical support service currently covered under company warrant, only an authorized Advanced Sterilization Products (ASP) engineer can perform required preventive maintenance and repair services on the sterilization systems and equip the STERRAD Model 100 NX and STERRAD Model 100S with proprietary parts. In addition, these systems are high-demand devices used in the processing of medical instrumentation. The estimated value for this FY11 requirement is $30,028.04. 4. Authority Cited: The statutory authority permitting other than full and open competition is 41 U.S.C. 253 (c)(1) Competition Requirement, as implemented by the Federal Acquisition Regulation (FAR) Subpart FAR 6.302-1 entitled Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirement. Under the authority of 41 U.S.C. 253 (c)(1) and FAR 6.302-1(a)(2), When the supplies or services required by the agency are available from only one responsible source and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for. Further, FAR Subpart 6.302-1(c) prescribes acquisitions using a brand name description or other purchase description to specify a particular brand name, product, or feature of a product, peculiar to one manufacturer does not provide for full and open competition regardless of the number of sources solicited. 5. Reason for Authority Cited: In accordance with (IAW) company s policy and service agreement terms and conditions, only engineers trained and certified by Advanced Sterilization Products (ASP) are authorized to repair and/or service ASP s trademarked STERRAD systems and provide proprietary parts available solely from the servicing company. Therefore, compliance is required: service attempted or performed by any person or company not authorized to perform such service will constitute a breach of the agreement and will consequently void the warranty on the STERRAD systems currently in operation at Baltimore VA Medical Center. 6. Efforts to Obtain Competition: NA 7. Determination of a Fair and Reasonable Cost: The Contracting Officer will determine that the anticipated cost to the Government is fair and reasonable based on a complete analysis of all costs or a price analysis will be fully utilized prior to award of the contract. 8. Market Research: As noted in Question 4, the Federal Acquisition Regulations (FAR) authority Sole source awards may be used when only one responsible source and no other supplies or services will satisfy agency requirements and will affect the VA in meeting its organizational mission in a timely manner, thereby, precluding full-and-open-competition consideration. 9. Any Other Supporting Facts: (See Question 5) Compliance with the specifics of the warrant and the service agreement is required: service attempted or performed by any person or company not authorized to perform such service will constitute a breach of the agreement and will consequently void the warranty on the STERRAD systems currently in operation at Baltimore VA Medical Center. This single factor precludes modification to enhance competition. Thus, acquiring a service contract with a potential contractor other than the suggested source can potentially prove too costly and injurious to the Government. 10. Listing of Sources: The VA Service Department will develop an acquisition strategy and pre-plan for any upcoming requirements or renewals which will provide potential Contractors with opportunities and resources for supporting the VA in the future acquisitions. 11. Action to Increase Competition: (See Question 10).
