Description
Class Justification For Other than Full and Open Competition For State Terminal Law Enforcement Databases and Video Capture Service 1. Identification of the agency and contracting activity: Agency: Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) Logistics and Acquisition Division (LAD) 99 New York Avenue N.E. Washington, D.C. 20226 2. Name and/or description of the action being approved: This justification seeks authority to negotiate and award sole source purchase orders for the acquisition of State Terminal Law Enforcement Databases and Video Capture Service connections. 3. Description of Supplies/Services to Include Period of Performance and Estimated Value: ATF supports and maintains a communication/connectivity system with vendors to provide law enforcement sensitive information used in support of ATF's investigations. ATF's communications/connectivity systems are installed and housed in ATF field offices throughout the continental U.S., Hawaii, Puerto Rico and Alaska. In these locations ATF is charged a fee to house the communications/connectivity system monthly, quarterly or annually. The fee is established to pay for this service and renewed yearly as long as coverage is needed to support ATF operations. The estimated value of all orders that may be placed is $500,000. ATF's proposes to award sole source purchase orders for these services. Authority to act under this class justification expires on September 30, 2011. 4. Statutory Authority Cited and Reason for this Authority: The statutory authority permitting other than full and open competition is Title 41 U.S.C. 253(c)(1) as implemented by FAR 6.302.1, "Only one responsible source and no other supplies or services will satisfy agency requirement." 5. Demonstration of Contractor's Unique Qualifications or Nature of the Acquisition that Requires use of Authority Cited: This service is only available from the provider/vendor that can provide the required "State Terminal Law Enforcement Databases and Video Capture Service" connections that will meet ATF's law enforcement communication/access needs. 6. A Description of efforts made to ensure that offers are solicited from as many potential, including whether a notice was or will be publicized as required by Subpart 5.2: The class justification for other than full and open competition will be published on www.fedbizopps.gov. It will offer notice of our intent to award on a sole source basis. 7. Fair and Reasonable Cost Determination: The contractor shall charge the standard commercial rate based on their commercial price list. Also, to ensure price reasonableness the contract specialist will review historical procurement records to ensure fair and reasonable prices have been obtained. 8. Formal Acquisition Plan/Market Survey to include a List of Interested Sources/Efforts to Obtain Competition/Offerors Solicited/Actions to Increase Competition and Overcome Competition Barriers: No additional efforts to obtain competition were conducted. Only one vendor can provide the "State Terminal Law Enforcement Databases and Video Capture Service" connections. 9. Any other facts supporting the use of other than full and open competition: Based on the circumstances of ATF's needs, only one source will provide the capabilities and services required by ATF. 10. Listing of sources, if any, that expressed, in writing, an interest in the acquisition: None at this time. Only that service provider can be utilized. Proposed contractor to be utilized will be determined at time of procurement award. 11. Statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the required supplies or services: There is only one source that can provide the "State Terminal Law Enforcement Databases and Video Capture Service" connections. 12. Certification, File Documentation: I certify that the facts and representations included in this justification and its supporting acquisition documents are complete and accurate to the best of my knowledge and belief. A copy of this class justification must be included in the contract file. Effective Date This class justification is effective on the date of signature below.
