- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity : Department of Veterans Affairs, Service Area Office 8, NCA-8, VA Caribbean Healthcare System, San Juan, Puerto Rico. Purchase Requests numbers applicable to this acquisition are: 672-11-3-433-0070, 672-11-3-434-0030 and 672-11-3-435-0030. 2.Nature and/or Description of the Action Being Processed: This is a request for other than full an open competition, for the procurement of Security Guard Service, to award a new short term (six months) firm- fixed- price contract at the VACHS and other premises while the long term contract is awarded. 3.Description of Supplies/Services Required to Meet the Agency s Needs: Services to be acquired are Unarmed Security Guard Services under NAICS code 561612 Security and Patrol Services . Contractor shall provide necessary labor, equipment, supplies, vehicles, transportation and supervision to render such services at the VACHS and other VA premises through the Island. Estimated value of required services is $374,228.90 for a six months performance period from April 1, 2011 thru September 30, 2011 4.Statutory Authority Permitting Other than Full and Open Competition: (X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The VACHS is in urgent need of acquire Security Guard Services in order to avoid interruption of services while the long term contract is awarded. This service is critical to support the VA Police service and accomplish VA Mission. A thorough market research has been conducted revealing that only one SDVOSB is in compliance with necessary permits and licenses as well as verified in the VIP. The agency need for the services is of such urgency that the government could be injured if patient safety, employees, visitors and property is threatened due to potential Safety matters. The Commonwealth of PR requires Companies in the Security Business to possess a Private Detective License issue by the PR Police Department in order to practice such business. An official list of authorized Security Guards companies to practice was obtained from the PR Police Department in order to corroborate whether or not companies registered in CCR and VetBiz under NAICS 561612 were in compliance with Law 108 Titled: Ley de Dectectives Privados de 1965 . Only one SDVOSB Company was found in both searches. There is only one SDVOSB Company verified in VetBiz that possesses the necessary license to exercise such business in Puerto Rico in accordance with the local law. Contractor is a duly established business in the Security Service Industry. Preliminary assessment demonstrated that company has the knowledge and capability to perform according to the statement of work and could assimilate the work required effective immediately. This will ensure a smooth phase in phase out process in order to avoid interruption of this critical service. Limiting completion will avoid unacceptable delays in fulfilling this critical service. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: CCR Search: Out of Seven (7) Companies registered as SDVOSB s in CCR database, under NAICS 561612, only one of them (One Corps, Inc.) seems to be indeed an established company in the security business. However, all companies were contacted via telephone and it was confirmed their expertise and specialty was not in the Security Services area. VetBiz search: Three (3) companies are listed/registered. Two (2) of them are SDVOSB, one of those two (GIRE Developments) is a construction company not a Security Services Company. The other SDVOSB is indeed a Security Company and is verified by CVE (One Corps Inc.). Although the remaining company is registered as a VOSB, is not verified by CVE yet. Company is indeed a Security Service established Company. However, it was contacted to corroborate the verification status and executive supervisor indicated that there do not comply with the active duty requirement. An onsite visit/inspection was performed by the CO, the VA Police Service Chief, VA Police Assistant Chief and VA Police Detective to the only company that appears registered at the PR Police Department as well as in the VetBiz as a verified company. On site visit outcome was a positive one. A sources Sought Announcement for this short term action was not posted since CCR and Vetbiz results in conjuction of PR Police Department List of Authorized Security Companies were substantial evidence. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Anticipated cost for this acquisition is $374, 229.00 which is consider a fair and reasonable price. This determination is based on a pre-negotiation objective developed taking in consideration all applicable economic factors that will impact this acquisition. Although Cost & Pricing data requirement does not apply to this acquisition, a detail price evaluation to include all direct and indirect associated cost will be performed to ensure that final negotiated contract price will be fair and reasonable. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: A market research in accordance with FAR Part 10 was conducted to determine if there are sources capable to satisfy the agency requirement and to determine if such sources has the necessary capabilities to perform the work in accordance with Government specifications. Sources utilized for market research were: Previos Sources Sought announcement of April 2010. CCR database, VetBiz database, PR Police Department list of Authorized Companies to excersice the Security Busineess in the Island, Phone Calls to vendors registered in CCR and VetBiz with NAICS561612 and Site Visits. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: The Commonwealth of PR requires Companies in the Security Business to possess a Private Detective License issue by the PR Police Department in order to practice such business. Only one company appeared registered in both lists. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: See Section VI above. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:: Future acquisition for this services is being planned under a competitive scenario. Based on market research conducted it is expected to have competition under the VOSB socioeconomic group.
