Description
THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent to award a sole source under statutory 10 USC 2304(c)(1), set forth in Federal Acquisition Regulation 6.302-1, "Only one Responsible Source and No other Supplies or Services Will Satisfy Agency Requirements." The Department of Veterans Affairs, James A. Haley Veterans Hospital (JAHVH), 13000 Bruce B. Downs., Tampa, FL 33612 requires annual maintenance and inspection of seven (7) CAT 3516 Engines and Generators. James A. Haley Veterans Hospital (JAHVH), Facilities Management intends to make an award to Ring Power Corporation, 9797 Gibsonton Drive, Riverview, FL 33569. NAICS 811310 with a size standard of $7M. No solicitation document is available. Interested parties may request a copy of the Statement of Work prior to the closing date of this notice via email only. Telephone requests will not be accepted. Per FAR Part 5.207-13(e) Fed Biz Ops Numbered Note 22 applies and is modified to read: The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received within five days after date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) Ring Power is the factory authorized distributor for Caterpillar for the entire five state region of the Southeast United States, Zone 1. The subject equipment is currently under warranty with Ring Power and the warranty would be void if service is provided by an unauthorized Caterpillar Zone 1 agent. Any other service companies would have to get their parts, and use their technicians to be able to perform the services to factory specs. Also, there is proprietary software in the computer controls of the generator system and any attempt at repairs would have to include access to that information via computer. The entire building, including the generator systems, is under warranty. The warranty for the generators is from Caterpillar, through the local dealer, Ring Power. The warranty states that all maintenance must be performed on the system to manufacturer ™s recommendations. The warranty also specifies that the maintenance must be performed by an authorized dealer. Ring Power is the only authorized dealer for the local area. The generators are all microprocessor controlled, in that the entire control panel is computerized. In order to operate and maintain the generators and engines, a technician must connect a computer to the controller to access information on the unit, alarm settings, engine parameters, etc. This requires specific software to be installed on the computers that are connected to the generators. This software is proprietary, and only authorized Caterpillar dealers and their employees have access to it.
