- 1.Contracting Activity: The Department of Veterans Affairs, Medical Center, Salisbury, NC, Veterans Integrated Service Network (VISN) 6, Network Contracting Activity (NCA) plans to contract by means other than full and open competition in response to procurement request 659-11-3-028-0118. 2.Nature and/or Description of the Action Being Processed: This is a request for other than full and open competition for the procurement of a drill system used for implanting surgical screws. The system is sold through the manufacturer, Stryker Orthopaedics, and a firm fixed price contract will be awarded. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The products required by the Salisbury Surgery Department are listed below. The total system cost is $25,390.00. The surgeons at the Salisbury VAMC have been borrowing Stryker Drill Sets from the manufacturer for use in the OR. The surgeons use the drills to create holes in bone for surgical screws, and to install and remove said screws. The manufacturer has begun to conduct trials in other facilities and will pick up the loaned instruments on May 12, 2011. These instruments have been used by every surgeon each day she/he operates. The vendor can provide a set for the Salisbury VAMC to be delivered by May 20, 2011, which will prevent cancellation of surgeries at the medical center. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Prior to obtaining the loaner set from Stryker, two other drill sets were tested by the surgeons. The Stryker set provided the best results for the Veterans undergoing surgery. Stryker is the only source for their surgical drills and parts, resulting in an inability to solicit from resellers. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Stryker offers discounted VA pricing, reflected in the estimated cost. When comparing prices to those on schedule, it appears the estimated cost of this procurement would result in similar pricing if similar items were bought using FSS schedules. However, it is difficult to do an exact comparison with schedule pricing as the drills and bits being procured are smaller than those on schedule. Prior to borrowing the equipment, patients requiring the procedures allowed by this system were sent for surgery on a fee-basis. Since borrowing the equipment more than 12 patients have been able to have the procedure at the Salisbury VAMC, providing a significant cost savings to the medical center. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted though examination of products offered at GSA Advantage. The hospital conducted market research through comparison of products from three vendors. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: None. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: See Section VI above. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The contract specialist has offered to work with the customer from the beginning of the acquisition process, vice starting involvement after evaluation, structuring solicitations around the evaluation of different products to allow for a seamless purchase once a decision has been made by the customer and funding has been approved.
