Description
DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1. Contracting Activity: Department of Veterans Affairs, VISN 16, Michael E DeBakey Medical Center 2. Nature and/or Description of the Action Being Processed: This is a sole source Firm Fixed Price procurement of a virtual eye surgery simulator software upgrade through VRMagic. 3. Description of Supplies/Services Required to Meet the Agency's Needs: EyeSi virtual simulator for eye surgery from VRMagic Inc. The software is estimated at $63,000. This request is for the upgrade software to make the equipment compatible with the hardware we presently own and cannot use because it needs the upgrades. There is an estimated time of delivery of 30 to 60 days. 4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §253(g), as implemented by FAR 6.302-1 ( X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority The FAR 6.302-1 exception to full and open competition applies as VRMagic is the sole direct subsidiary of the parent company VRMagic GmbH, which developes and manufacturers the EyeSI system and is the only contractor with the requisite knowledge, experience and technical data that can meet the Government's requirements on a timely basis. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Market research was conducted and found that only VRMagic could provide software upgrades to the Eyesi simulator. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable. The Contracting Officer determines that the anticipated cost to the government will be fair and reasonable because a complete analysis of all costs or a price analysis will be fully utilized prior to award of the contract. 8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: A search of GSa vendors, SDVOSB vendors under the NAICS code 333319, and a CCR search found that no other company could provide this software. 9. Any Other Facts Supporting the Use of Other than Full and Open Competition: The Houston VA Medical Center purchased the Eysi Hardware platform previously. Since then the need to upgrade the software arised and the this type of software is proprietarty to each eye surgery simulator. VRMagic is the proprietary vendor that provides this software. 10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: VRMagic 11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Since VRMagic is the sole direct distrubuter of the Eyesi system, there have been no actions taken to remove the barriers to competition.
