- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 1, Boston VA Medical Center Medical Service/Respiratory Transaction # 523-11-2-7914-0230 2.Nature and/or Description of the Action Being Processed: REQUEST FOR OXYGEN DELIVERY FOR BOSTON VA HEALTHCARE SYSTEM FOR REMAINDER OF THE FISCAL YEAR. AN ADDITIONAL REQUEST HAS ALREADY BEEN SUBMITTED UNDER TRANSACTION # 523-11-2-7914-0164 FOR AN ANNUAL DELIVERY CONTRACT W/ OPTION YEARS. THIS EMERGENCY TRANSACTION WILL BE PUT IN PLACE FOR THE NEXT FEW MONTHS IN ORDER TO PROVIDE OXYGEN FOR THE HOSPITAL UNTIL THE NEW CONTRACT IS ESTABLISHED. OXYGEN IS A CRITICAL REQUIREMENT FOR DIRECT PATIENT CARE OF RESPIRATORY PATIENTS. 3.Description of Supplies/Services Required to Meet the Agency's Needs: Tanks of oxygen for all three campuses of the Boston VA healthcare system. Approximately $13,000.00/month Includes e- cylinders and h tanks. 4.Statutory Authority Permitting Other than Full and Open Competition: ( X ) (2) Unusual and Compelling Urgency per FAR 6.302-2; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): This is the product to be utilized in conjunction with equipment already owned by the VA. Air Gas East is the current vendor supplying oxygen to the Boston VA Medical Centers. A new contract with option years is currently being devolved with an estimated start date of June 1, 2011. This emergency transaction will be awarded to the incumbent Air Gas East for the following months while the new contract is being competed in order to ensure there is no disruption of supplies to the hospital, which would result in a direct patient care issue. It was estimated that the PO would only be needed for the next three months but it was funded through 09/30/2011 in case of any unforeseen circumstances in the development of the new contract. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: No other vendors were contacted at this point in time. Air Gas East is the current vendor supplying oxygen to the Boston VA Medical Centers. A new contract with option years is currently being devolved with an estimated start date of June 1, 2011. This emergency transaction will be awarded to the incumbent Air Gas East for the following months while the new contract is being competed in order to ensure there is no disruption of supplies to the hospital, which would result in a direct patient care issue. It was estimated that the PO would only be needed for the next three months but it was funded through 09/30/2011 in case of any unforeseen circumstances in the development of the new contract. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated dollar value of the proposed acquisition is $72,750.00. The Contracting Officer determined that the anticipated price will be fair and reasonable based on the fact that Air Gas East is the current vendor supplying oxygen to the Boston VA Medical Centers. A new contract with option years is currently being devolved with an estimated start date of June 1, 2011. This emergency transaction will be awarded to the incumbent Air Gas East for the following months while the new contract is being competed in order to ensure there is no disruption of supplies to the hospital, which would result in a direct patient care issue. It was estimated that the PO would only be needed for the next three months but it was funded through 09/30/2011 in case of any unforeseen circumstances in the development of the new contract. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: No Market research was conducted due to the extreme urgency of this request. Tanks on station are owned by the vendor referenced on the request. Air Gas East is the current vendor supplying oxygen to the Boston VA Medical Centers. A new contract with option years is currently being devolved with an estimated start date of June 1, 2011.
