Description
VA-69D-11-RQ-0913 The Great Lakes Acquisition Center (GLAC) in Milwaukee, WI intends to negotiate on a sole source basis (IAW FAR 13) with Conmed Corporation, 525 French Road, Utica, NY 13502 as the only source that provides a probe capable to meet the Hines VA needs. Specifically, the contractor shall provide the following: - Complete Beamer Mate System with all accessories (Part #CE200, Quantity 5); This acquisition is being conducted under simplified acquisition procedures (IAW FAR 13). There are no set-aside restrictions for this requirement. The intended procurement will be classified under North American Industry Classification System (NAICS) 339112 with a Small Business Size Standard of 500 employees. This notice of intent is not a request for competitive proposals and no solicitation document exists for this requirement. However, parties interested in responding to this notice will need to submit technical data sufficient to determine capability in providing the same product. All capability statements received within 5 days after publication of this synopsis will be considered by the Government. A determination by the Government not to compete based on responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Capability statements shall be submitted by email only as a MS Word or Adobe PDF attachment to Scott Ivy at scott.ivy@va.gov Statements are due by 12:00 CST 05 July 2011. No phone calls accepted. DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 12, Great Lakes Acquisition Center, 5000 W. National Avenue, Milwaukee, WI 53295. 2. Nature and/or Description of the Action Being Processed: Justification and approval for Other Than Full and Open Competition for the purchase of five (5) Conmed Beamer Mates with all accessories, for the Edward Hines VA Hospital in Hines, IL per Purchase Request# 578-11-3-969-0139. Award of a new firm-fixed price contract is anticipated. This procurement will proceed on a sole source basis with Conmed Corporation. 3. Description of Supplies/Services Required to Meet the Agency's Needs: The Edward Hines VA Hospital has a requirement for five (5) Conmed Beamer Mates with all accessories, along with add-on equipment. The total procurement cost is $180,475. Delivery is expected within 90 days of the Notice of Award. 4. Statutory Authority Permitting Other than Full and Open Competition: FAR 6.302-1(a)(2). The VA's minimum needs can only be satisfied by unique supplies or services available from only one source (41 USC 253 (c)(1)). 5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The following unique features are incorporated into the ConMed Beamer: -Is a GI Specific platform -Has a ceramic tip Argon probe, which reduces eschar from sticking to the tip of the probe, thus reducing procedure time -Audio/Visual patient electrode monitoring -Argon Beam Snare Probe is a proprietary device which has the ability to resect tissue and apply Argon with a single device which will minimize exchanges, therefore reducing procedure time and improving patient outcomes. -Low Argon Flow Rate reduces risk of gas embolism -Bicap Sense Stop Technology is a safety feature that measures tissue impedence, which gives the physician the ability to predetermine the level of hemostasis they wish to achieve, and the unit stops once predetermined threshold is met. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Other vendor's products were evaluated but did not have all the required features. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: There are no prior awards for this on FBO and Conmed owns the patent for the new technology. The requesting medical facility personnel who are experts in their field feel this is an appropriate amount for the needed equipment. I concur with my medical staff. 8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: There is no comparable product on the market that I could find. 9. Any Other Facts Supporting the Use of Other than Full and Open Competition: Nothing on GSA, VA NAC, VETBIZ, SBA. 10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None. 11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: None. 12.
