- The United States Environmental Protection Agency, Office of Water (OW) has a need for a contractor to provide sampling and analytical services to the EPA for its consideration in the development, assessment and revision of effluent limitation guidelines and standards that are under the Clean Water Act of 1987 (CWA), as amended. The EPA is seeking a contractor to perform tasks including:(a)Assessment and development of revised or new industrial effluent limitation guidelines (ELG)s; (b)Development or review of new or revised chemical, radio-chemical and microbial analytical methods;(c)Review of whole effluent toxicity (WET);(d)Sampling ? related activities for a variety of sample types. This may include planning, actual sampling, and/or coordination of sample distribution to laboratories and analysis of samples collected by teams other than the contractor;(e)Sample analysis of field samples. This may include identifying and subcontracting for the services of an appropriate laboratory; sample analysis, review of such analyses, and database development and/or maintenance;(f)Development, implementation, and audits of quality assurance/quality control procedures and related training materials; (g)Development and management of databases for effluent guidelines and other environmental programs;(h)Technical support for regulations, enforcement, litigation, and cooperative monitoring efforts;(i)Technical support in implementing and streamlining OW?s test methods approval program (CWA alternate test procedures (ATP); SDWA ATP); (j)Statistical support;(k)Providing technical support in developing responses to questions of approved and modified methods including development of call log of questions asked and answered;(l)Training, outreach, peer review, and logistical support;(m)Meeting and professional facilitation support. The successful contractor shall provide technical, analytical logistical, and information technology support to the EPA in its efforts supporting analytical responsibilities. The successful contractor shall provide all necessary labor, materials, facilities, and services in support of the efforts. A draft PWS can be obtained from the OAM website, http://www.epa.gov/oam/cinn_cmd/. Be advised, Performance Work Statement changes are possible when the Request for Proposal (RFP) is released. Due to unavoidable organization conflict of interests, the Government will exclude any entities that own or operate an analytical laboratory and firms that act in consulting, advisory, or legal capacities with, or for, firms trying to overturn or circumvent 40 CFR Part 136 Analytical methods, effluent guidelines or standards or regulations, policies, or guidance pertaining to wastewater for consideration for award for any resultant contract. Interested parties are advised that EPAAR solicitation provisions (EPAAR 1552.209-70 and 1552.209-72) requiring the offeror to certify that it is unaware of any potential Conflict of Interest or, otherwise, to disclose any potential Conflict of Interest of which it is aware, shall be required. The Contractor must be capable of providing support for the required services in an unbiased and objective manner. Without prior authorization from the EPA cognizant contracting officer the contractor, during the life of this contract, will be ineligible to enter into any contract or represent any party, other than EPA, that act in a consulting, advisory, or legal capacity with, or for, firms or parties trying to overturn or circumvent 40 CFR Part 136 Analytical Methods, effluent guidelines or standards or regulations, policies, or guidance pertaining to wastewater and will be ineligible to own or operate an analytical laboratory. All offerors will be required to specifically disclose whether they have any business or financial relationships with firms in the following industries in order to provide the Agency with an opportunity to assess its vulnerabilities relative to organizational conflicts of interest of individual offerors prior to award: ?Firms that are engaged in conventional and unconventional oil and gas extraction?Firms that are engaged in energy production?Firms that are engaged in Seafood Processing?Firms that are engaged in central waste water treatment?Firms that are engaged in municipal waste water treatment?Firms that are engaged in ore mining activities?Firms that manufacture organic chemicals, plastics, and synthetic fibers?Firms that manufacture inorganic chemicals It is anticipated that the resultant contract will be a Cost-Plus-Fixed-Fee-Term type contract starting in December 2011 with one 12-month base term plus four (4) 12-month options. The base level of effort for each term is approximately 13,500 direct labor hours. Options to increase the level of effort for each term by up to an additional 13,500 direct labor hours will also be included. The applicable NAICS code for this requirement is 541620 with a size standard of $7,000,000. This is a follow-on requirement to contract EP-C-06-085. The solicitation is anticipated to be released in late August, 2011 and the close date shall be approximately 45 days thereafter. A copy of the solicitation will be available on EPA?s website at the following location: http://www.epa.gov/oam/cinn_cmd. This office does not intend to mail hard copies of the solicitation. It is the responsibility of the offerors to frequently check the EPA website for updates or changes. All responsible sources may submit a proposal which will be considered by the agency.
