Description
In accordance with HHS policy guidance, OPM needs to acquire an accredited independent review organizations contractor to provide Federal external review services. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The Solicitation number is: OPM15-11-T-0009 and is issued as a Request for Quotations (RFQ). This solicitation document incorporates all mandatory commercial item provisions and clauses that are in effect through Federal Acquisition Circular (FAC) 2005-53 dated August 4, 2011. The North American Industrial Classification System (NAICS) code is 541990 and the small business size standard is $7.0 million. This procurement is unrestricted, allowing both large and small business to submit proposals. Section 1001 of the Patient Protection and Affordable Care Act (the Affordable Care Act), Public Law 111-148, added a new section 2719 to the Public Health Service Act (the PHS Act). The Affordable Care Act also added a new section 715(a)(1) to the Employee Retirement Income Security Act (ERISA) and section 9815(a)(1) to the Internal Revenue Code (the Code) incorporating the provisions of part A of title XXVII of the PHS Act (including PHS Act section 2719) into ERISA and the Internal Revenue Code (IRC) and making them applicable to group health plans and health insurance coverage in connection with group health plans. The Departments of Health and Human Services (HHS), Labor, and the Treasury (the Departments) published interim final regulations implementing the provisions of PHS Act section 2719, regarding internal claims and appeals and external review processes for group health plans and health insurance issuers offering coverage in the group and individual market, on July 23, 2010, at 75 FR 43330 (IFR)1 and amended these regulations on June 24, 2011, at 76 FR 37208 (amended IFR)2. This contract relates to the administration of the Federal external review process referenced in those regulations and administered by the Office of Personnel Management (OPM) through agreement with the HHS, Center for Medicare and Medicaid Services (CMS), Center for Consumer Information and Insurance Oversight (CCIIO). In accordance with HHS policy guidance, OPM needs to acquire an accredited independent review organizations contractor to provide Federal external review services. The Federal external review services will be available to individuals in the individual market and fully insured small group and large group health insurance markets in states (and territories) that have no applicable State processes for external review. The process will also be available to enrollees of non-grandfathered, self-insured, non-Federal governmental health plans in every state except those, as identified by HHS, where such plans are specifically subject to an applicable State process for external review. (OPM) intends to award one or more Firm-fixed Price contracts based on anticipated caseload to the offeror(s) that represents the best value to the government. The contractor shall provide all labor, incidental materials, and other services necessary to render services under the resulting contract, see Statement of Objectives detailed below. The period of performance is for three (3) years (base year and two (2) one-year periods). The base period is anticipated to be October 1, 2011 through September 30, 2012. If multiple contracts are awarded, the government is interested in ensuring a consistent and uniform Federal external review process for self-insured, non-Federal governmental group health plans and certain health insurance issuers throughout the country. OPM will determine the number of contracts to award based on anticipated caseload, the need for back-up capacity in the case of contractor non-performance, and the demonstrated experience and capacity of offerors to adjudicate different types of review cases, especially cases that include both the need for clinical expertise and legal interpretation of the insurance contract. Thus, offerors shall clearly state their capacity and experience with adjudicating complex cases covering multiple issues (such as medical necessity and coverage issues). Offerors are invited to submit their quotations to OPM-Contracting Group in response to this notice by 10:00 AM Eastern Standard Time (EST), September 1, 2011. Only emailed requests for additional information will be accepted at terri.miller@opm.gov through 10:00 AM EST, August 16, 2011. Quotations submitted in response to this notice shall include the solicitation number in the subject line and be signed, dated and submitted via email to terri.miller@opm.gov. Vendors not registered in the Central Contractor Registration (CCR) database and not registered in the VETS-100 database at the time the requirement is anticipated to be awarded will not be considered.
