Description
JUSTIFICATION AND APPROVAL TO PROCURE USING OTHER THAN FULL AND OPEN COMPETITION 1. Identification of Agency and Contracting Activity. This Justification and Approval (J&A) for Other Than Full and Open Competition is executed by the Center for Acquisition Innovation (CAI) Frederick, Frederick, MD on behalf of the Department of Veterans Affairs, Office of Small Disadvantage Business Utilization (OSDBU). 2. Nature/Description of Action. This activity proposes to negotiate a noncompetitive award (sole source) with Halfaker and Associates, LLC, for the procurement of the VA Open House for National Veterans Small Business Conference and Expo on August 15, 2011 - August 19, 2011. 3. Description of Supplies/Services. The Veterans Affairs Office of Small and Disadvantaged Business Utilization (OSDBU) is responsible for the planning, implementation, and execution of programs which impact the involvement of Small Business (SB) Small Disadvantaged Business (SDB), Woman-Owned Small Business (WOSB), Service-Disabled Veteran Owned Small Business (SDVOSB), Veteran Owned Small Business (VOSB), and businesses in Historically Underutilized Business Zones (HUBZone). This responsibility also includes the planning of activities and management of the Mentor Protégé Program (MPP). Specific categories of support include but are not limited to: Database Management, Statistical Analysis and Reporting, Outreach, Conference/Symposia, Website Management, Reports, Program Management, Advanced Acquisition Forecast, Market Research, Program Area Support, Administrative Support and Special Assignments. This contract is intended to provide quick-reaction professional, technical, analytical and management resources and support to supplement in house expertise. VA OSDBU serves as advisor to the Secretary of the VA on small business related matters in support of the VA's mission. The office also spearheads initiatives to maximize business opportunities for small business by synchronizing critical resources through extensive marketing counseling, and training. VA OSDBU provides policy, guidance, direction, and education to the VA acquisition community to assist in the implementation of the VA Small Business Program. VA OSDBU will hold the Annual National Veteran Small Business Conference to support SDVOSB/VOSBs in August 2011. OSDBU identified the need for a VA Open House to provide information, assistance and support for Veterans. Therefore, the purpose of this requirement is to establish a contract for VA Open House during the Annual National Veterans Small Business Conference. The estimated value of this requirement is $400,000.00. 4. Identification of Statutory Authority. The statutory exception permitting other than full and open competition for this acquisition is 10 U.S.C. 2304(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements as implemented by FAR 6.302-1. 5. Demonstration of Contractor's Unique Qualifications. Halfaker and Associates, LLC has a current contract to provide support services for the Annual National Veterans Small Business Conference and Expo for August 15 - 19, 2011. The VA Open House is required to be held at the same location on August 17, 2011, which is in three weeks. In performing services under the Annual National Veterans Small Business Conference contract, Halfaker has gained institutional knowledge of the requirements and needs of the Government and private stakeholders through extensive support during the planning of the event. Additionally, Halfaker has completed negotiations for space, materials, logistics and other aspects relating to the event as part of the current contract which has made Halfaker familiar with the venue, location, and materials that will be needed for the VA Open House. Based on the time constraints for this event, it would not be possible for another vendor to accomplish the required tasks in such a short period of time. Therefore, Halfaker has been determined to be the only responsible source able to provide the VA Open House. 6. Description of efforts made to ensure offers are solicited from as many potential sources as practicable. A notice of intent to sole source will be posted in the Federal Business Opportunity System pursuant to FAR 5.203(a). 7. Determination of Fair and Reasonable Prices. No award shall be made until the Contracting Officer determines the costs to the Government to be fair and reasonable. This determination will be based on sources such as comparison of other contracts' for same or similar services, the contractor's public price list, Internet Search Engines and Halfaker and Associate's quote. 8. Description of Market Survey. Halfaker and Associates, LLC is the only source that can provide the services for the VA Open House and is a responsible source under NAICS code 561920 with respect to this contracting opportunity. 9. Other facts supporting the use of other than full and open competition. The intention of the VA Open House was to establish a forum to provide Veterans information on potential benefits they may be entitled to and to assist in starting application process. Sole-sourcing to Halfaker will ensure these services are provided to the Veterans. 10. Listing of Interested Sources. All future requirements will be handled on a case-by-case basis.
