- The National Institute of Standards and Technology (NIST), intends to negotiate, on a sole source basis, under authority of FAR 13.106-1(b)(1), with Reczek and Associates, East Amherst, NY, for the purchase of follow-on consultation services for Program Development and Strategic Planning to support the NIST Standards Coordination Office. NIST cites FAR 6.302-1(a)(ii)(A) (see excerpt below) as primary rationale for Sole Source Determination. (ii) Services may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in - (A) Substantial duplication of cost to the Government that is not expected to be recovered through competition. Sole Source determination is based on the following: In 2011, Reczek and Associates was contracted to perform a standards-intelligence needs assessment directed at senior-level NIST management and staff in the Standards Coordination Office and the Standards Services Group (SSG). The outcome of that work was an analysis of the information needs of NIST leadership and resulted in the framing of new services and programs to be undertaken by the Standards Services Group and the Standards Coordination Offices to meet those needs. As part of the information needs assessment in 2011, the services procured from Reczek & Associates resulted in an assessment of the Notify U.S. database, including a customer/user survey and the definition of new use-scenarios. The follow-on services required will extend this study by refining, testing and implementing the suggested services and programs identified by Reczek & Associates. The services required will extend this work by supporting the re-design of the Notify U.S. database to define new database functionality, to streamline data entry, and offer new user functionality. To introduce a new contractor in this follow-on services requirement would result in considerable costs to the Government and would adversely impact the progress of this project. In addition, to introduce a new contractor will result in unacceptable delays in completion of two critical undertakings NIST is to complete: 1.) The re-design of the Notify U.S. database of WTO Technical Barriers to Trade notifications now used by over 3,000 export and standards professionals in the USG and the US business community. 2.) Modeling, design, prototyping, and introduction of new information-related services offered by the NIST SSG: This activity is to begin in the near-term with a staff meeting, facilitated by the contractor, to build staff consensus on information needs and products. Commitments have been made related to the event date and location. A change in contractor will require that these commitments be revisited resulting in this activity not being launched in a timely manner. Further, the knowledge of NIST information systems and needs acquired by Reczek & Associates as a result of the Standards Intelligence Study conducted in 2011 is the framework for the modeling, design, prototyping, and introduction of new information-related services. Based on the above, Reczek and Associates, is the only vendor capable of providing the required follow-on consulting services that meets the Government's minimum requirements. The period of performance for his procurement is one (1) year. The North American Industry Classification System (NAICS) code for this acquisition is 541611, and the size standard is $7,000,000. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, the Government will consider responses received by September 13, 2011, 3:30 p.m. EST. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
