Description
FEDBIZOPS NOTICE OF INTENT FOR SOLE SOURCE: 1. The 10CONS/LGCB, Operational Contracting Office, USAF Academy intends to award a sole source firm fixed priced contract to Blue Gauntlet Fencing Gear for the purchase of Uhlmann Fencing Equipment. This procurement is for the acquisition of a sole source commercial item using simplified procedures in accordance with FAR Part 12 and 13. 2. The North American Industrial Classification System (NAICS) number is 334419 and the business size standard is 500 employees. a. Only one responsible source and market research reveals that no other manufacture will satisfy the USAFA requirement. b. Uhlmann-Fechtsport, distributed through Blue Gauntlet Fencing Gear, Inc. is the only approved source for this acquisition. This equipment will replace the current fencing system that has become outdated and needs numerous repairs. The USAFA requires a permanent and flush set-up that allows the USAFA gymnasium to be used for multiple sporting events. Design plans dictate a permanent fixture in-ground reel system that can then be covered up and the facility to be used for other events. c. Changing already approved design plans to accommodate a different type of system would be costly and cost would be unrecoverable. d. This request is issued for the USAF Academy Athletic Department. Uhlmann-Fechtsport, distributed through Blue Gauntlet Fencing Gear is the only known source that meets the USAFA requirements. The Delivery date is 30SEPT2011. 3. REQUIREMENT: a. CLIN 0001: Signal Unit-Uhlmann -QTY 3 b. CLIN 0002: Signaling Unit Stick Module Universal (Foil/epee/sabre)- Uhlmann -QTY18 c. CLIN 0003: Wall-mounted Indication Lights with Integrated Universal-signaling Unit Board (Foil/epee/sabre)- Uhlmann -QTY 18 d. CLIN 0004: Wall-mounted Indication Lights "BS" - Uhlmann -QTY 18 e. CLIN 0005: Cable Reel - Uhlmann -QTY 36 f. CLIN 0006: Sub Floor Box with Plate for Cable Reel and Selection Switch -Uhlmann -QTY 36 NOTE: IUID & SHIPPING AND HANDELING COSTS MUST BE INCLUDED IN THE ITEM PRICE. 4. This synopsis in reference to Solicitation #: F4BHM01158A002 is for informational purposes only and does not constitute a solicitation for bids or proposals. DO NOT submit a bid/quote at this time. 5. Any offerors believing they can provide the required Uhlmann Fence Scoring System to include all of the associated items of the requirement described above may provide evidence for consideration. Evidence must support the offeror's claim they can provide this brand name or equal. All qualified sources may submit a response, which if timely received, will be considered by this agency. Information received will be considered solely for the purpose of determining whether a competitive procurement can be conducted. A determination not to compete this proposed procurement based on response to this notice is solely within the discretion of the Government. Responses must be received via e-mail NLT 12:00 pm Mountain Standard Time (MST) on 9 September 2011. Responses received after this will be considered late IAW FAR 52.212-1(f) and will not be evaluated. 6. The Government does not intend to pay for any information provided under this announcement. Contractors must have a current registration with the Central Contractor Registration (CCR) at http://www.ccr.gov and with Online Representations and Certifications Application (ORCA) at http://orca.bpn.gov. 7. The closing date of this synopsis is 12:00 pm, Mountain Standard Time (MST) on 9 September 2011. 8. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of quotes, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the party to another official who can resolve the concern. (b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions). (d) The ombudsman has no authority to render a decision that binds the agency. (e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. Such inquiries shall be directed to the Contracting Officer. (End of clause) 52.211-6 -- Brand Name or Equal As prescribed in 11.107(a), insert the following provision: Brand Name or Equal (Aug 1999) (a) If an item in this solicitation is identified as "brand name or equal," the purchase description reflects the characteristics and level of quality that will satisfy the Government's needs. The salient physical, functional, or performance characteristics that "equal" products must meet are specified in the solicitation. (b) To be considered for award, offers of "equal" products, including "equal" products of the brand name manufacturer, must- (1) Meet the salient physical, functional, or performance characteristic specified in this solicitation; (2) Clearly identify the item by- (i) Brand name, if any; and (ii) Make or model number; (3) Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and (4) Clearly describe any modification the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modification. (c) The Contracting Officer will evaluate "equal" products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer. (d) Unless the offeror clearly indicates in its offer that the product being offered is an "equal" product, the offeror shall provide the brand name product referenced in the solicitation.
