Description
The National Institute of Standards and Technology (NIST) intends to negotiate, on a sole source basis, in accordance with the guidance for FAR Subpart 13.106-1(b) with Tanner Research, Inc. of Monrovia, California for the purchase of L-Edit MEMS Mask Level Layout Editor with DXF Import/Export & Curve Tool, and 2 year license renewal. The L-Edit MEMS software is currently used for mask design in several projects within the Nanofabrication Research Group at the CNST. Renewal of the two existing licenses is required for several ongoing projects within the group, while acquisition of a third license is required due to new projects and users within the group. Continuing to use L-Edit MEMS for mask design is a necessity to maintain compatibility with existing research efforts. Tanner Research is the sole distributor of this software. Delivery shall be FOB Destination and be completed in accordance with the Contractor's commercial schedule. The North American Industrial Classification System (NAICS) code for the acquisition is 511210, and the size standard is $25 million. No solicitation package will be issued. this notice of intent is not a request for competitive quotations, however, the government will consider responses received by September 12, 2011. A determination by the governemnt not to compete the proposed acquisition based upon responses to the notice is soleley within the discretion of the government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
