- The Naval Air Systems Command intends to negotiate a sole source firm fixed price contract with BAE Systems of Greenlawn, NY for AN/UPX-41(C) Digital Interrogator (DI) production units, Mode 5 change kits to be used to upgrade fielded AN/UPX-37 DI units to the AN/UPX-41(C) configuration, and the attendant technical/logistics support. Estimated quantities to be procured under this contract are as follows: FY 12 Basic Award - approximately 10 AN/UPX-41(C) DI production units, approximately 35 Mode 5 change kits, and the attendant technical/logistics support; FY 12 Mid Year Option - approximately 24 Mode 5 change kits and the attendant technical/logistics support; and FY 13 Option -- approximately 5 AN/UPX-41(C) DI production units, approximately 47 Mode 5 change kits, and the attendant technical/logistics support. The Government does not intend to use the provisions of FAR Part 12 for this action. The statutory authority permitting other than full and open competition is Title 10 U.S.C., 2304(c)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.230-1, only one responsible source and no other supplies or services will satisfy agency requirements.
