- The purposes of this amendment are as follows: #1) to provide answers to seven (07) questions asked. #2) to incorporate additional security language. Question 1: Please advise if this is a new requirement or there is an incumbent providing these services. Answer: There is an incumbent providing the Space and Facilities Management Services. Question 2: If there is an incumbent, please provide information on the same such as contractor name, contract period of performance, contract amount, etc. Answer: The incumbent is Battistello Consulting Inc. For additional information concerning the contract, you may submit a Freedom of Information Act (FOIA) request. Please visit the NHLBI FOIA request website at http://www.nhlbi.nih.gov/about/foia.htm for additional information. Question 3: What GS equivalent for this contractor position. This requirement is not subject to the Service Contract Act of 1965, therefore FAR Clause 52.222-42, Statement of Equivalent Rates For Federal Hires (May 1989) is not included in the solicitation. Question 4: In the FBO posting it mentions that on-site office space will not be provided. --Please advise as to how the assigned person is to work off the premises. Can they work out of their residence? Answer: Yes. However, offerors will need to have the necessary equipment and facilities to complete the tasks listed in the statement of work. Question 5: 2080 Hours amounts to 40 hours per week. Please advise if the contract allows billing for the Overtime hours. Answer: The contract will not allow for overtime hours. Question 6: Is this a Firm Fixed Price or Time and Material. Answer: As stated in the combined synopsis/solicitation, the NHLBI intends to award a Firm Fixed Price contract. Question 7: Is there a format for the Cost Proposal? Answer: There is not a prescribed format for the Price Proposal. However, at a minimum, offerors should detail the number of hours proposed and the hourly rate proposed for the Base Period and each subsequent Option Period. ___________________________________________________________________________________ The following additional security language shall be incorporated by this amendment: Commitment to Protect Non-Public Departmental Information and Data. The Contractor, and any subcontractors performing under this contract, shall not release, publish, or disclose non-public Departmental information to unauthorized personnel, and shall protect such information in accordance with provisions of the following laws and any other pertinent laws and regulations governing the confidentiality of such information: - 18 U.S.C. 641 (Criminal Code: Public Money, Property or Records) - 18 U.S.C. 1905 (Criminal Code: Disclosure of Confidential Information) - Public Law 96-511 (Paperwork Reduction Act) Each employee, including subcontractors, having access to non-public Department information under this acquisition shall complete the "Commitment to Protect Non-Public Information - Contractor Employee Agreement" located at: http://ocio.nih.gov/docs/public/Nondisclosure.pdf. A copy of each signed and witnessed Non-Disclosure agreement shall be submitted to the Project Officer/COTR prior to performing any work under this acquisition. ACCESS TO NATIONAL INSTITUTES OF HEALTH (NIH) ELECTRONIC MAIL All Contractor staff that have access to and use of NIH electronic mail (e-mail) must identify themselves as contractors on all outgoing e-mail messages, including those that are sent in reply or are forwarded to another user. To best comply with this requirement, the Contractor staff shall set up an e-mail signature ("AutoSignature") or an electronic business card ("V-card") on each Contractor employee's computer system and/or Personal Digital Assistant (PDA) that will automatically display "Contractor" in the signature area of all e-mails sent.
