AMC: 1G History: Contract Awarded January 18, 1990 to Cage Code 0DB54 on Contract F34601-90-C-0537 for 318 each. The Estimated Unit Price: $14,811.50. L/I 0001 - 3 Year Basic Requirements with a BEQ of 33; includes a First Article Test Report and Certification Data for Material. Mandatory Language: Note: Item Description: Length 38.0000 (IN), Height 8.0000 (IN), Width 30.0000 (IN), Weight 25.0000 (LB). Item Function: RH INDB LDG Gear Door Assembly. Dimensional door made of cast aluminum. Attaching parts include rub strip, seal, and hinge half, nut plates, rivets, miscellaneous hardware. The door provides aerodynamic covering for landing gear during flight operations NHA PN 5-88197-2. Material: Aluminum. Currently The Boeing Company (Cage 81205) is the only known source that can satisfy the Government requirements. This acquisition is a Rights Guard acquisition for the competitive procurement of replenishment spare parts, and requires special certifications to protect technical data of The Boeing Company. It is suggested that small business firms or others interested in subcontracting opportunities in connection with the described procurement make contact with the firms(s) listed: Boeing (Cage 81205). The Boeing Company which has licensed the Government to use same for the procurement of replenishment spare parts for Unit States Government owned aircraft (E-3, E-8, and/or KC-135 aeries aircraft) and for no other purpose. Rights Guard technical data shall not be disclosed, in whole or in part, to any other person or entity other than to supplier's bidder's offeror's employees, having a need to know and who are under an obligation to preserve and protect such data under terms and conditions no less restrictive than those imposed herein, and then only for the purposed if responding to this solicitation or performing any resulting contract. The suppliers/dodders/offerors hereunder are prohibited from (1) reproducing, in whole or in part, Rights Guard Technical data; (2) incorporating any information contained in such Rights Guard Technical Data into other documentation; or (3) otherwise utilizing such Rights Guard Technical Data, except for responding to this solicitation or performing any resulting contract. Each supplier/bidder/offeror shall include the authorized DFARS Limited rights legend of 252.227-7013, Right in Technical Data-Noncommercial Items (March 2011), identifying the Boeing Company as the owner, on all Rights Guard technical data that is incorporated, in whole or in part, into any technical data delivered by such supplier/bidder/offeror to the Government in response to this solicitation or as part of the performance of any resulting contract. In the case of the limited rights legend, the contractor shall indicate such Rights Guard technical data as not being subject to an expiration date, if such date is required by the limited rights legend authorized under its contract. Rights Guard technical data provided by Tinker Air Force Base, including any copies thereof, is to be destroyed according to the following schedule: Immediately upon decision to "no bid" the solicitation for which data was received. Within 15 days of being advised your company was not the successful bidder for the solicitation for which the data was requested and received. If the contract awardee, within 15 days of contract completion. NOTE: Suspected and actual instances of data retention provided by Tinker AFB beyond these timeframes will be reported to The Boeing Company for remedy. Furthermore, failure to comply with this obligation shall be grounds for your removal from the list of qualified bidders for any other solicitation involving Boeing technical data. The Government and/or the Boeing Company shall have the right to audit supplier's/bidder's/offeror's records to ensure the destruction of Boeing proprietary data. The reviews may be conducted after giving fifteen (15) days written notice in advance of such reviews. All suppliers shall comply with MIL-STD-130 for the purpose of distinguishing any spare parts made using Boeing Rights Guard technical data. An Ombudsman has been appointed to hear concerns from offerors or potential offerors during the proposal development phase of this acquisition. The purpose of the Ombudsman is not to diminish the authority of the Program Director or Contracting Officer, but to communicate contractor concerns, issues, disagreements, and recommendations to the appropriate Government Personnel. When requested, the Ombudsman will maintain strict confidentiality as to source of the concern. The Ombudsman does not participate in the evaluation of proposal or in the source selection process. Interested parties are invited to call the Ombudsman at (405) 734-8241. DO NOT CALL THIS NUMBER FOR SOLICITATION REQUESTS. Written procedure will be used for this solicitation. No telephone requests. Only written or faxed request received directly from the requestors are acceptable. All responsible sources solicited may submit a bid, proposal, or quotation, which shall be considered. Note: Faxed solicitation requests can be submitted to DLA Aviation, Tinker AFB OK 73145, and FAX NUMBER (405) 739-4237. "Notice to Offerors: Fiscal Year 12 funds are NOT presently available for this acquisition. No award will be made under this solicitation until funds availability is certified. The proposed contract is restricted to domestic sources under the authority of FAR 6.302-3. Accordingly, foreign sources, except Canadian sources are not eligible for award.
