- Introduction: Pursuant to FAR Subpart 13.106-1(b)(1), the U.S. Army RDECOM Contracting Center, Natick Contracting Division, on behalf of the PM SOF intends to award a firm fixed price purchase order on a sole source basis to: Oceanic Safety Systems, LLC, 552 N. Victoria Ave., Ventura, CA 93003. THIS IS NOT A REQUEST FOR PROPOSALS. No solicitation document is available. 1) FAR Statutory Authority cited: 13.106-1(b)(1) only one responsible source and no other supplies or services will satisfy agency requirements. 2) Nature and description of the supplies or services required to meet the agency's needs: The Government intends to award a contract to Oceanic Safety Systems for the CO2-SAFE-M system. The CO2-SAFE-M system is a patented actuator that automatically inflates a floatation bladder using a combination of pressure and time as determined and set by the operator and manufacturer prior to use. The device is also capable of switching from various activation modes (i.e. automatic [either pressure and time or water contact] to manual) using a remote communicator. The intent is to award a Firm Fixed Price type contract below the simplified acquisition threshold. 3) A demonstration that the proposed contractor is the only source available to provide these services or goods (i.e. unique qualifications, proprietary rights, etc.): Oceanic Safety Systems is the only contractor that a commercially available actuator with the described capabilities. The vendor holds a patent for this particular pressure and time actuated device. 4) A description of the market research that was conducted and the results, or a statement of the reason a market research was not conducted: A request for information was posted on 13 Oct 11 for 30 days for a pressure activated floatation system. Two vendors responded with a pressure activated device that could be set to various depths. One of these 2 vendors was Oceanic Safety Systems. In addition to pressure activation, Oceanic's device is also activated on a set time, which is a capability of interest to the Government. The Government also intends to procure the 2nd vendors system for comparison. 5) Any other facts supporting the use of other than full and open competition: NA 6) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required: Not feasible at our level.
