Description

JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION (1)Identification of the agency and the contracting activity: Program Contracting Activity East - St. Louis VA Medical Center, Bldg. 2 #1 Jefferson Barracks, Drive St. Louis, MO 63125 (2) Nature and/or description of the action being approved. The Office of Employee Education Services (EES) plans to contract by means other than full and open competition for a Firm Fixed-Price contract. The proposed awardee is "NCO LLC" (3) A description of the supplies or services required to meet the agency's needs (including the estimated value). The service is an educational presentation from Mr. Cochran on his recovery within the DVA healthcare system from an IED injury he sustained from war. Mark Earhardt will accompany him on the performance of the song "Hope" written as a tribute to the DVA and the services Stephen received. This presentation will serve as a reminder and motivator to the VHA staff in attendance as to why they do the work they do. Country singer Stephen Cochran's song "HOPE" was written for the United States Department of Veterans Affairs as an anthem of hope and healing for wounded veterans The estimated cost of this proposed acquisition is $5,000.00. This is a one time contract. (4) An identification of the statutory authority permitting other than full and open competition. ( ? ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; (2) Unusual and Compelling Urgency per FAR 6.302-2; (3) Industrial Mobilization, Engineering, Developmental or Research Capability Or Expert Services per FAR 6.302-3; (4) International Agreement per FAR 6.302-4 (5) Authorized or Required by Statute FAR 6.302-5; (6) National Security per FAR 6.302-6; (7) Public Interest per FAR 6.302-7; (5) A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. a. Only One Responsible Source (FAR 6.302-1) - Stephen Cochran experiences with VA interventions after his war injuries and his talent as a musician make him uniquely qualified to provide the following services in: -Relate resuscitation experiences on the battlefield and in the while under medical care -Relate the successful innovative medical intervention he received, which required virtual just-in time medical staff training to the same kind of training innovations currently taking place in resuscitation initiatives in the VA. -Challenge each participant to be the same kind of advocate he encountered to receive his innovative treatment -Relate how the because of the innovative care based on state of the art training as well how a single VA employee made a difference in his life that allowed him to pursue his dreams and career as a national-recognized musician -Demonstrate his musical talent to the VA employees in attendance and provide motivation to instill I CARE principles though the performance of his song, "Hope." While there are many veterans who have received innovative treatment and who had advocates for their care as well as many talented veterans; only Stephen Cochran meets all the service requirements as a wounded veteran, recipient of innovative care in the VA, and talented nationally-known musician. The services being provided are unique to this vendor as the one that has rights to the performance of the song "Hope" which is being requested to be performed as part of the presentation service. (6) Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The services being provided are unique to only this vendor as having rights to the song "Hope." (7) A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. Reference FAR 15.404-1(b)(2)(iv), the price has been determined fair and reasonable since comparison with competitive published price lists, published market prices of commodities, similar indexes, and discount or rebate arrangements has been used. The current Market price for this service is $6000, however, the government is receiving it for $5000. (8) A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted. Researched Google and VetBizOps no other vendor could be found to provide this required service. (9) Any other facts supporting the use of other than full and open competition: - The use of multiple modes of training and providing team-based responsive training that follows the latest research are incorporated into the agenda of the VHA Resuscitation Education Conference. - Stephen Cochran has a unique and compelling story of injury, treatment, care experiences and recovery that can amplify this message. - Stephen Cochran can speak directly to innovative and proactive interventions facilitated by incorporating advanced, multi-modal, just-in-time training that provided him with an opportunity for a cutting edge, team-based surgical intervention. - As a nationally known recording artist, Stephen Cochran uses both his experiences as a veteran and his gift as a musician to convey his message of hope in a way no other speaker can. (10) A listing of the sources, if any, that expressed, in writing, an interest in the acquisition. See Section 6 above. (11) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. This justification for other than full and open competition is for services that are not currently available from another qualified source. To overcome barriers to future competition for these services, a "Sources Sought" announcement could be placed in the Federal Business Opportunities website 12. Requirements Certification: I certify supporting data is the responsibility of technical or requirements personnel (e.g., verifying the Government's minimum needs or schedule requirements or other rationale for other than full and open competition).
