Description
I.INTRODUCTION:This notice is a combined synopsis/solicitation for commercial items prepared inaccordance with the format in FAR Subpart 12.6, as supplemented with additionalinformation included in this notice. This announcement constitutes the only solicitation; offers are being requested and awritten solicitation will not be issued. This notice is being issued as a Request forQuotations (RFQ) for a single, or multiple, Blanket Purchase Agreements (BPAs) to provideRADIUS /4D Software Programming, Maintenance, and Development services at NASA AmesResearch Center (ARC).The BPA(s), awarded to a single offeror or multiple offerors, forall or some services, will be selected on a best-value basis, to responsible offeror(s)meeting NASA ARCs requirements.The BPA(s) will not obligate any funds. The Government estimates, but does notguarantee, that a BPA task order will have a total minimum amount of $150.00 and a totalmaximum amount of $30,000.00.The BPA(s) issued under this RFQ will have a period of performance from date of awardthrough March 31, 2017. The period of performance of all BPA task orders will end nolater than March 31, 2017.All responsible sources may submit an offer which shall be considered by the agency. II.BACKGROUND:NASA/ARC has a requirement for on-site software programming, support, development, andmaintenance of the existing RADIUS /4D database. ARC uses the 4D database to track theFacilities and Center Operations business base. Modules are developed, maintained, andenhanced as the business models change due to business and Agency policy changes. Modulesinclude: Cost Obligation System Tracking (COST), Tool Inventory Management System (TIMS),and Electronic Time Distribution System (TIMES).NASA/ARC desires to receive the RADIUS / 4D Software Programming, Maintenance, andDevelopment services in a manner that provides the Government with the right to accessand use the software source code in order to meet Government requirements, includingfuture solicitations. Any proposed delivery of limited rights data or restrictedcomputer software shall be identified to the Contracting Officer along with anexplanation of the proposed rights that will be provided to the Government enablingNASA/ARC to access and use the software as described.III.SPECIFIC TASKS: - Serve as Database Administrator/Designer for the 4D software production system. - Perform software upgrades and modifications as required. - Create custom financial reports to provide information for managers to track the statusof tasks. - Provide training to system users on an as needed basis. - Provide software development support if enhancements are required. - Maintain the web based task request system. - Create web based service request input system to be implemented Center wide. - Modify existing 4D software to become a 2-factor authentication system in accordancewith NASA Agency requirements. All NASA systems are required to use 2-factorauthentications using one of the two approved methods from The Office of Management andBudget (OMB). These two methods include Active Directory using Kerberos andeAuthentication using SUN policy agent or SAML2.- Deliver software source code with unlimited rights. IV.PLACE OF PERFORMANCE:The place of performance for the required services is NASA Ames Research Center, MoffettField, CA.V.CLAUSES and PROVISIONS:The Government intends to acquire a commercial item using FAR Part 12 and the SimplifiedAcquisition Procedures set forth in FAR Part 13. (Feb 1998) This solicitation incorporates one or more solicitation provisions by reference, with thesame force and effect as if they were given in full text. Upon request, the ContractingOfficer will make their full text available. The offeror is cautioned that the listed provisions may include blocks that must be completed by the offeror and submitted withits quotation or offer. In lieu of submitting the full text of those provisions, theofferor may identify the provision by paragraph identifier and provide the appropriateinformation with its quotation or offer. NFS 1852.219-76, NASA 8 Percent Goal, NFS 1852.237-73 Release ofSensitive Information, and NFS 1852.227-86, Commercial Computer Software--Licensing.The following identified ARC clauses are incorporated in full text:ARC 52.227-93 Management and Protection of Data (Jul 1988)(a)In the performance of this contract it is anticipated that the Contractor mayhave access to, be furnished, use, or generate the following types of data (recordedinformation):(1)data submitted to the Government with limited rights orrestricted rights notices;(2)data of third parties which the Government has agreed to handleunder protective arrangements; and(3)data generated by or on behalf of the Government which theGovernment intends to control the use and dissemination thereof.(b)In order to provide management appropriate for protecting the interestsof the Government and other owners of such data, the Contractor agrees with respect todata in category (a)(1) above, and with respect to any data in categories (a)(2) and(a)(3) when so identified by the Contracting Officer, to:(1)use and disclose such data only to the extent necessary toperform the work required under this contract, with particular emphasis on restrictingdisclosure of the data to those persons who have a definite need for the data in order toperform under this contract;(2)not reproduce the data unless reproduction of the data isspecifically permitted elsewhere in the contract or by the Contracting Officer;(3)refrain from disclosing the data to third parties without thewritten consent of the Contracting Officer; and(4)return or deliver the data including all copies thereof to theContracting Officer or his designated recipient when requested by the ContractingOfficer.(End of Clause)ARC 52.227-96 Handling of Data (Jun 1989)(a)Paragraph (d)(1) of the 'Rights in Data--General' clause of this contract permitsthe Government to restrict the Contractor's right to use, release to others, reproduce,distribute, or publish any data first produced or specifically used by the Contractor inthe performance of the contract provided such restriction is expressly set forth in thecontract. Pursuant to this authority, the following restrictions shall apply to such dataand shall be included, in substance, in all subcontracts:(b)Data specifically used.(1)In the performance of this contract, it is anticipated theContractor may have access, or be furnished, data (including financial, administrative,cost or pricing, or management information as well as technical data or computersoftware) of third parties which the Government has agreed to handle under protectivearrangements, as well as such Government data for which the Government intends to controlthe use and dissemination.(2)In order to protect the interests of the Government and theowners of such data, the Contractor agrees, with respect to such third party orGovernment data that is either marked with a restrictive legend or specificallyidentified in this contract or in writing by the Contracting Officer as being subject tothis clause, to use and disclose such data only to the extent necessary to perform thework required under this contract, preclude disclosure of such data outside theContractor's organization, and return or dispose of such data as directed by theContracting Officer when the data is no longer needed for contract performance.(3)Notwithstanding (2) above, the Contractor shall not be restrictedin the use and disclosure of any data that becomes generally available without breach ofthis clause by this Contractor, is known to or is developed by the Contractorindependently of any disclosure of proprietary, restricted, or confidential datahereunder, or is rightfully received by the Contractor from a third party withoutrestriction.(c)Data first produced.Data first produced by the Contractor under this contract may includedata for which the Government wants to control the use and dissemination. TheContracting Officer may require, or this contract may presently specify, that theContractor apply restrictive legends to such identified data prior to delivery to theGovernment, or to third parties at the Government's direction, that restrict the use anddisclosure of the data by any third party recipient. However, such restrictive legendsshall in no way affect the Contractor's or the Government's rights to such data asprovided in the 'Rights in Data--General' clause of this contract.(End of Clause)ARC 52.227-97 Subcontracting and Data Rights (Nov 2010)(a)The Contractor shall flow down the data rights provisions of thiscontract to lower tier subcontractors to ensure that it can fulfill its data rightsobligations to the Government.See Clause FAR 52.227-14(h), Rights in DataGeneral. TheContractor shall be held responsible to obtain rights for the Government where it failsto fulfill such obligations. (b)Pursuant to Clause FAR 52.227-14(c)(2), the Contractor must obtainContracting Officer approval before incorporating any data not first produced under theContract into data delivered under the contract. Before delivering such data, theContractor must identify it and explain what rights it proposes to deliver, or acquire onits behalf, as NASA/ARC desires to receive the RADIUS /4D Programming, Maintenance, andDevelopment services in a manner that provides the Government with the right to accessand use the software source code in order to meet Government requirements, includingfuture solicitations. (c) The Government hereby invokes the handling, use and non-disclosureobligations contained in Clauses ARC 52.227-93 and ARC 52.227-96 with respect tosensitive government information that it receives access to during contract performance,specifically including sensitive data/information included in reports generated by theRADIUS / 4D software. (End of Clause)ARC 52.223-91 Disaster Assistance and Rescue Team (Dart) Participation (Apr 2004)(Modified Jan 2012). a. Contractor employees are eligible to participate in the Disaster Assistance andRescue Team (DART) if approved in writing by the Contractor and appointed by theGovernment. If a Contractor approves of an employees participation, the contractoragrees to modify the employees position description to include participation in DART,and to provide additional indemnification (e.g., workers compensation insurance, generalliability, etc.) as may be necessary to protect its employee and/or the Government whilethe employee is participating in the program.b. DART Definition. This team is comprised of civil service, contractor, AmesAssociate, resident agent, and military personnel that work at Ames Research Center, theNASA Research Park, and Moffett Federal Airfield. The team composition includes, but isnot limited to, scientists, engineers, wind tunnel mechanics, aircraft mechanics,facility maintenance personnel, computer specialists, industrial hygienists, safetyprofessionals, heavy equipment operators, administrative personnel, managers, procurementofficials, and data specialists. DART is an umbrella organization that has sixfunctional groups. The groups are Search and Rescue, Damage and Utility Control,Structural Assessment, Emergency Communications, Medical, and Logistics. Typically,participation will involve approximately 5% of the employees (full) time, except forinitial training/orientation, which will involve approximately 10% of the employees(full) time. The executive management at Ames Research Center strongly encouragescontractor participation on DART, which needs all of our support, as it has proven to bea valuable element of the Center's Emergency Preparedness Program.(End of Clause)VI.PREPARATION OF OFFER:Offerors are required to submit their quote via e-mail to Uyen.K.Tu@nasa.gov no laterthan 4:30PM PST on 03/09/2012. Quotations must include solicitation number, FOBdestination to NASA ARC, proposed working plan, discount/payment terms, taxpayeridentification number (TIN), identification of any special commercial terms, and besigned by an authorized company representative.Offerors shall provide burdened, hourly labor rates for the on-site software developmentand support services described in part II. Selection will be made based on the offer that represents the best value (as defined inFAR 2.101) and results in the lowest overall cost alternative (considering proposedtechnical merit, past performance, and price).Offerors shall state in their offer their its business size status for this procurementsNAICS Code of 541512 - Computer Systems Design Services, with a size standard of $25M.Offerors must be registered in the Central Contractor Registration (CCR) and the OnlineRepresentations and Certifications Application. Offerors may obtain information onregistration and annual confirmation requirements via the internet at http://www.ccr.gov and https://orca.bpn.gov/ All contractual and technical questions regarding this acquisition must be submitted inwriting via e-mail to Uyen.K.Tu@nasa.gov no later than 4:30PM PST on 02/29/2012.Telephone communications are not acceptable.Prospective offerors shall notify this office of their intent to submit a quotation.
