Description
The U.S. Army Special Operations Command, Fort Bragg, North Carolina intends to negotiate on a sole source basis with The Fox Company under the authority of 10 U.S.C. 2304-(1) as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. In accordance with FAR 6.302-1 (a) (2) (ii), these items are determined to be peculiar to one manufacturer and not available from any other sources. Supplies may be deemed to be available only from the original source in the case of a follow-on contract for highly specialized equipment when it is likely that award to any other source would result in -- (1) Substantial duplication of cost to the Government that is not expected to be recovered through competition, or (2) Unacceptable delays in fulfilling the agency's requirements. (See 10 U.S.C. 2304(d)(1)(B) or 41 U.S.C. 253 (d)(1)(B).) USASOC's requirement is the purchase of fifteen (15) name brand (CONSEW and JUKI) and highly specialized sewing machines, the installation of the equipment in Yuma, Arizona, and the training required to operate all of the sewing machines. The Fox Company was the original awardee for the initial purchase of CONSEW and JUKI sewing machines and is still under contract with the ongoing sewing machine maintenance contract. The items purchased will fall under the maintenance contract already in place. This notice is not a request for offers. The contractor identified is the only known source for the subject requirement. However, any other responsible vendor believing they have the capability of meeting the requirement may submit their capabilities to include technical documentation to establish the potential of meeting the Government's need. To be considered, any such documentation shall be submitted in writing by 12 March 2012 at 1:00 PM EST. No extensions will be granted. A determination not to compete the proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether or not bona fide competition exists. The applicable NAICS code is 333292 (Textile Machinery Manufacturing). The Government will not pay for any information submitted. Electronic submissions will be accepted.
