- The Food and Drug Administration (FDA), Center for Tobacco Products (CTP), intends to issue a solicitation to obtain services from a contractor to identify tobacco product advertisements. The contractor(s) will provide a list of all publications that sell, promote, market and/or advertise tobacco products to customers in the U.S. This is not a solicitation for proposals. The purpose of this notice is to obtain capability statements regarding the availability and capability of qualified small business sources for the proposed acquisition. Responses to the information requested will assist the Government in determining the appropriate acquisition method, including whether a small business set-aside is possible. The NAICS Code for this requirement is 541990, All Other Professional, Scientific and Technical Services. The FDA intends to solicit request for proposals using the Federal Supply Schedule of the General Services Administration. Background On June 22, 2009, the President signed the Family Smoking Prevention and Tobacco Control Act (Tobacco Control Act) into law (Public Law 111-31). The Tobacco Control Act amended the Federal Food, Drug, and Cosmetic Act (Act) and granted the Food and Drug Administration (FDA) authority to regulate the manufacture, marketing, and distribution of tobacco products. Currently, FDA regulates the following tobacco products: cigarettes, cigarette tobacco, roll-your-own tobacco, and smokeless tobacco. See Section 901(b) of the Act. The Act allows FDA to issue regulations asserting jurisdiction over other tobacco products, such as cigars, cigarillos, e-cigarettes, and hookahs, among others. FDA expects to issue a deeming regulation in summer 2012 to cover other tobacco products. FDA also expects other guidance documents or regulations to be issued during the contract period and expects the project to reflect those changes as they take effect. Objective The overall objective of this project is to identify, collect, record, and track information on tobacco advertisements in electronic and hard copy publications (i.e., newspapers, magazines, alternative weekly papers, periodicals, trade journals, direct mails, and emails) to aid in our routine surveillance of promotional materials by tobacco industry. Tobacco advertisements include those for cigarettes, smokeless tobacco products, cigarette tobacco, and roll-your-own tobacco that are currently regulated by FDA, and other tobacco products that will be deemed under FDA jurisdiction once regulations are issued. Desription of Work The contractor will be required to identify tobacco product advertisements. In addition, the Government will help to identify keywords, presentations, and promotions that indicate a potential violation of the Tobacco Control Act, and will provide a list of currently regulated tobacco product types and a list of potential tobacco product types that may come under FDA's authority when the final deeming rule is published. The contractor(s) will provide a list of all publications that sell, promote, market and/or advertise tobacco products to customers in the U.S. The Government will work with the contractor(s) to finalize the list of publications to be reviewed and approve the final list of publications. The contractor shall review all such publications and identify and record specified information for tobacco advertisements. The contractor will review every issue of each publication with tobacco product advertisements during the contract period. The contractor(s) shall provide biweekly reports to the Government. The contractor(s) shall complete the following specific tasks: 1. Using established search criteria and keywords, identify all publications that sell, promote, market and/or advertise tobacco products to customers in the U.S.; 2. Provide the Government with a list of every publication that has tobacco advertisements (as identified in 1 above); 3. Identify and record the various information (if available) for every tobacco advertisement that promotes, markets, advertises and/or sells cigarettes or smokeless or other tobacco products in publications to consumers in the U.S.: a. Type of tobacco product (e.g., cigarettes, cigarette tobacco, roll-your-own tobacco, smokeless tobacco, pipe tobacco, cigars, e-cigarettes, etc.). b. Brand of each tobacco product. c. Contact information for the entity responsible for the tobacco advertisement d. Publication name and issue or other identifying information e. Number of tobacco advertisements in each publication f. Whether the advertisement promotes to customers in the U.S. g. Whether a tobacco advertisement contains keywords or promotions that may indicate a potential violation of the TCA for tobacco products that FDA currently regulates h. What potential violations appear in the tobacco advertisements based on the keywords or promotions that are present i. Whether the publication is an adult publication j. Identify patterns and trends of identified tobacco advertisements 4. Organize the data in Microsoft Excel and Access with searchable and sort-able columns for each category of required information. 5. Incorporate the Government's current data that has been collected prior to the initiation of the project with the contractor(s) data in Microsoft Excel and Access. 6. Provide all tobacco advertisements every two weeks (biweekly), on a Tuesday for the previous two week period. If Tuesday is a holiday, the tobacco advertisements will be provided on the following Wednesday. with the date and name of the publication. 7. Provide documentation for an internal system for assuring quality and accuracy of information collected and recorded. 8. Provide statistics, based on the data collected every two weeks, on Tuesday (at the same time the tobacco advertisements are provided) for the previous two week period. These statistics may be revised by the Government to reflect new policy, regulation, Agency guidance, or as needed. 9. Provide quarterly statistics, based on the data collected, identifying data patterns and trends (e.g., increases in a tobacco product's advertisements because of the Great American Smokeout, market testing of a new product, or new state/local tobacco control laws or decreases in cigarette advertisements with a corresponding increase in smokeless advertisements by a manufacturer). 10. The contractor(s) and the Government will meet in person, or by teleconference with a video sharing program (e.g., Adobe Connect), to permit simultaneous viewing of documents. Contract Type This is an anticipated firm fixed price type contract. Period of Performance Base Period (13 Months from date of award) CAPABILITY STATEMENT This notice is issued for informational purposes and is not a request for competitive proposals. Any interested party should submit a statement of capabilities in sufficient detail to determine if the requirements of this synopsis can be met, no later than 15 days from the date of this announcement. The solicitation will be available on or about May 30, 2012, on the General Services Administration, e-Buy website at https://www.gsaadvantage.gov/advantage/login/eBuyLogin.do. Prospective offerors are responsible for downloading the solicitation and amendments. It is the offerors responsibility to monitor the General Services Administration, e-Buy website for the release of the solicitation and amendments.
