- J&A 16.505(b)(2)(i)(B) HSHQDC-12-J-00121 This acquisition is being conducted in accordance with FAR 16.505(b)(2)(i)(B), “Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. ”HPES is uniquely qualified to perform this requirement HPES is the designer, developer, and installer of the ECC system currently in use. If any compatibility issues arise with the configuration, installation and integration of the CVR module into the ECC, HP is uniquely qualified to quickly address the issues. This action requires a Top Secret facility clearance and HPES is already working onsite. Awarding a task order to another vendor would cause delays in fulfilling the Government's requirements. It would take another vendor's personnel three to four months to go through the DHS security process. Enhancing the current ECC functionality through the acquisition of a CVR module will provide DHS with the ability to perform call quality monitoring of watch officer interactions with DHS Leadership. This ability to perform quality assurance is vital to DHS’s efforts to transition out contractor personnel and transition in full–time government employees. Award to a contractor other than HPES would result in significant and unacceptable delays in beginning this transition process. At a minimum, a new competitive solicitation award schedule will take almost 7 months before full performance can be realized. During this time it would take 90 days for a new contractor to learn the ECC system. Current Government personnel are not trained on the ECC system operations and would not be able to assist the new contractor. HPES will operate the system until the new federal employees are on boarded and will train the current watch officers and the new federal employees hired to operate the ECC system. They will also serve as the advisers to the DHS senior staff for matters related to ECC operations.
