- This contract action was accomplished using other than competitive procedures because there is only one responsible source due to a unique capability provided, and no other supplies or services will satisfy agency requirements (FAR 6.302-1). See posted J&A for further information. This is a NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT using Federal Acquisition Regulation FAR Part 13.106-1(b) - Soliciting From A Single Source and FAR 6.302-1 - Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements. The Army Contracting Command (ACC)-Aberdeen Proving Ground, Installation Division, 4118 Susquehanna Avenue, Aberdeen, MD 21005 has a requirement to procure the following items: 1 EA Systemic Blood Pressure Analysis Module Add-on for ecgAUTO software. Under the authority of FAR 6.302-1, "Only one responsible source and no other will satisfy agency requirements. The Government intends to award a Firm-Fixed Price, sole source contract to: EMK Technologies. EMK Technologies is the sole developer/manufacturer /distributor of the required software. The associated North America Industry Classification System (NAICS) Code is 541990 and the Business Size Standard is $7 million. The required software is currently being utilized for Systemic Blood Pressure Analysis Module. All responses received within ten (10) days after date of publication of this notice will be considered by the Government. A determination by the Government not to compete this proposed purchase order based upon responses to this notice is solely within the discretion of the Government. Interested persons may identify their interest and capability to respond to the requirement no later than 2:00 PM Eastern Time, Tuesday, May, 23, 2012. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements.
