- ATTACHMENT 1 This is a combined synopsis/solicitation for commercial items prepared in accordance with the format prescribed in Subpart 12.6 of the Federal Acquisition Regulation (FAR), as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number is stated above, and it is being issued as a request for quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-58, effective May 18, 2012. NAICS code 561320 applies.. The U.S. Maritime Administration (MARAD), Norfolk, VA intends to award an Indefinite Delivery Indefinite Quantity (IDIQ) firm fixed price purchase order for the James River Reserve Fleet - Fleet Operations Group Temporary Labor Services. Work shall be ordered by separate Task Orders issued by the Contracting Officer, Contracting Officer Representative (COR) or Assistant Contracting Officer Representative (ACOR). 0001 BASE YEAR - Vessel Movements Temporary Labor Duties may include, but are not limited to deck hand on craft, mooring crew on vessels, anchor work on vessels, anchor work on vessels, movement of de-watering pumps, and clean-up of vessels. Designate one individual as leader for work group; leader will be liaison between Contracting Officer Representative (COR) and contracted labor workforce; leader will also be part of the labor workforce. 0001AA - Straight Time: Monday - Friday, (0700-1530) excluding Federal Holidays 0001AB - Overtime/Holidays: Outside of Straight Time and on Federal Holidays 0002 BASE YEAR - Grounds Maintenance Temporary Labor Duties may include, but are not limited to, weeding, cutting grass, raking and sweeping as directed by Contracting Officer Representative (COR). Designate on individual as leader for work group, leader will be liaison between COR and contracted labor workforce; leader will also be part of the labor workforce. The leader will be assigned specific tasks by the COTR and divide the work as appropriate, reporting to the COTR when the assignment is complete and ready for inspection. 0002AA - Straight Time: Monday - Friday, (0700-1530) excluding Federal Holidays 0002AB - Overtime/Holidays: Outside of Straight Time and on Federal Holidays (See attached quote sheet for pricing base year plus four option years) The requested period of performance for the above service is within 15 days after award through 12 months plus the option to extend performance for four additional 12 month option periods (NTE 60 months). (OCT 1995) (a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $100.00, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract. (b) Maximum order. The Contractor is not obligated to honor: (1) Any order for a single item in excess of $50,000; (2) Any order for a combination of items in excess of $100,000 OR (3) A series of orders from the same ordering office within 7 days that together call for quantities exceeding the limitation in subparagraph (1) or (2) above. (c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) above. (d) Notwithstanding paragraphs (b) and (c) above, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 7 days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source. 52.216-22 INDEFINITE QUANTITY (OCT 1995) (a) This is an indefinite-quantity Indefinite delivery contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract. (b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum." The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum." (c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations. (d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after 31 MAY 2017. Minimum and Maximum Quantities (JUN 1994) As referred to in paragraph (b) of FAR 52.216-22 INDEFINITE QUANTITY clause, the contract minimum quantity shall be fulfilled with the issuance of the first Task Order. The maximum quantity shall not be exceeded except as may be provided by formal modification to the contract. 52.217-5 Evaluation of Options. (JUL 1990) Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s). 52.217-8 Option to Extend Services (NOV 1999) The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 10 days. 52.217-9 Option to Extend the Term of the Contract. (MAR 2000) a. The Government may extend the term of this contract for a term of one (1) to twelve (12) months by written notice to the Contractor within the performance period specified in the Schedule; provided that the Government shall give the Contractor a preliminary written notice of its intent to extend before the contract expires. The preliminary notice does not commit the Government to an extension. b. If the Government exercises this option, the extended contract shall be considered to include this option provision. c. The total duration of this contract, including the exercise of any options under this clause, shall not exceed 60 months. 52.232-18 Availability of Funds (APR 1984) Funds are not presently available for this contract. The Government's obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer. 52.232-19 Availability of Funds for the Next Fiscal Year. (APR 1984) Funds are not presently available for performance under this contract beyond 30 SEP 2012. The Government's obligation for performance of this contract beyond that date is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise for performance under this contract beyond 30 SEP 2012, until funds are made available to the Contracting Officer for performance and until the Contractor receives notice of availability, to be confirmed in writing by the Contracting Officer. DAMAGE TO GOVERNMENT FACILITIES: Damage to any facility, interior/exterior equipment, or systems caused by the contractor, as a result of work performed under this contract, shall be repaired by the contractor at his/her own expense. The contractor shall be required to repair or replace all items and components, to return the damaged area to its condition before the damage incident. APPLICABLE WAGE DETERMINATION: The following Department of Labor Service Contract Act Wage Determination is applicable to performance of work at the James River Reserve Fleet in Newport News, Virginia under this contract.
