Description
THIS IS A NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT AND NOT A REQUEST FOR PROPOSALS. The National Park Service intends to solicit a proposal and enter into a contract with Rieth Riley, 3626 Elkhart Road PO Box 477, Goshen, IN 46527. Under authority of FAR 6.302-1(a)(2)(ii). Please see the below Justification for other than Full and Open Competition for further details. This notice of intent is not a request for competitive proposals. However, the Government shall consider all responses received prior to the close date of this announcement. Written responses to this notice shall contain sufficient documentation to establish bonafide capability to fulfill the requirement. A solicitation is not available. These construction services will be procured in accordance with FAR Part 36, FAR Part 13 and Other Than Full and Open Competition as authorized under FAR 6.302-1. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (or SOLE SOURCE) 1.Nature and/or description of the item/service being procured and its intended use (include the anticipated cost): The Porter Brickyard Trail is approximately a 3 mile hike/bike paved trail being constructed primarily by the Town of Porter (Town), through grants from Indiana Department of Transportation (INDOT) and Federal Highway Administration (FHWA). The project was contracted through INDOT and the low bid was Reith-Riley. 2. Sole Source Justification rationale (Check one and explain below): __x____Only one responsible source. ______Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met. ______ Other _____________________________________________________ Explain: The trail is required to be designed to and constructed to the specifications of INDOT. There is a roughly mile portion being constructed by the National Park Service (NPS). This is due to a reroute necessary for environmental concerns of the original route. The section being constructed by the NPS must also be designed and constructed to the specifications of INDOT. The NPS has contributed to the planning and construction of the trail and is funding the entire section constructed by the NPS. 3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest: INDOT has a list of Certified Hot Mix Asphalt Producers; there are only 2 local contractors capable of meeting the asphalt specification for this project. They are Reith-Riley and Walsh-Kelly. Reith-Riley is currently contracted by the Town of Porter to construct the trail including placing the asphalt. They will be laying asphalt at both ends of the NPS section of trail. Reith-Riley has a contract price for placing asphalt from the contract bid price when they were low bid. They have offered to place our asphalt for the same price they are providing to the Town. By contracting with Reith-Riley the NPS would be obtaining asphalt at last year's price, and the NPS would save the cost of mobilization/work interruption that would be due to another contractor. 4. If this is a determination for sole source, the Contracting Officer certifies: a. Only one responsible source is available. b.
