- NOAA Class Deviation B NOAA Class Deviation A The Department of Commerce National Oceanic and Atmospheric Administration (NOAA)/Mission Support Division Norfolk, VA is issuing a notice of intent to negotiate sole source procurement with Reson Inc. for providing two (2) replacement EM7216 Receiver Arrays as well as two (2) custom SVP70 brackets for the NOAA vessel Ferdinand R. Hassler. This instrument is designed and manufactured by Reson Inc. The statutory authority is 41 U.S.C. 253(c)(1), Only One Responsible Source. The government intends to award a firm-fixed price purchase order for this requirement. The current requirement is to procure two (2) replacement EM7216 Receiver Arrays and two (2) custom SVP brackets. These replacement parts must be provided by Reson Inc. because the Receiver Arrays are the integral components of the existing Reson multi-beam 7125 system. The system is comprised of proprietary sensors and circuits only known and only capable of being maintained, repaired, and calibrated by Reson. Reson, as the original equipment manufacturer, is the only responsible party to have the requisite equipment and techniques to properly certify and test these components. To do otherwise would subject these systems to likely catastrophic failures resulting in the damage of very expensive and scarce scientific assets. The purchase of Receiver Arrays other than Reson's would require prohibitive time and expense for the new system to be successfully integrated into the Ferdinand R. Hassler and NOAA fleet mission systems. Also the new equipment would need to be validated under similar controlled at-sea test conditions. Because of the complications that arise, there would certainly be errors in hardware and thus the mission of the program would be compromised. To install a different type of Receiver Array would cause enormous disruption, result in errors, and cause unnecessary cost for the Government. No other entity can provide the necessary instrument and specifications required. If any other type of receiver array instrument was purchased without these specifications it would put the Government at a costly and severe disadvantage. The proposed contract action is for supplies and services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1(c). The applicable NAICS code is 334511. Interested parties may submit a capability statement, proposal, or quotation, which shall be considered by the agency. Responses shall be submitted by 12:00 p.m. Eastern Standard Time, June 15, 2012. All parties submitting quotes must complete and sign the amendments attached to this notice.
