Description
JUSTIFICATION AND APPROVAL TO PROCURE USING OTHER THAN FULL AND OPEN COMPETITION 1. Identification of Agency and Contracting Activity. This Justification and Approval (J&A) for Other Than Full and Open Competition is executed by the Strategic Acquisition Center (SAC), Fredericksburg, VA, on behalf of the Department of Veterans Affairs (VA), Service and Distribution Center (SDC). 2. Nature/Description of Action. This activity proposes to negotiate a noncompetitive award (sole source) with Wear-Mark, Inc. d/b/a All Seasons Apparel, for the procurement of Interment Flags. This contract is a lot purchase of 82,944 flags with delivery NLT September 30, 2012 and with 2 option lot purchases of 20,736 flags for each option lot with deliveries NLT end of October and November respectively. The period of performance will be June 1, 2012 - September 30, 2012 for the base period, October 1-31, 2012 for Option Period 1 and November 1-30 for Option Period 2.. Simultaneously, a 5 year contract for the purchase of interment flags is under SBA protest appeal. The Small Business Administration (SBA) determined the two apparent awardees were ineligible for award. This sole source contract mitigates a break in Interment Flag deliveries until the appeals process is complete and SBA renders a final decision. If the apparent awardees are deemed ineligible for award on appeal, this activity will continue to pursue the 5 year contract. 3. Description of Supplies/Services. The purpose of this requirement is to continue delivery of supplies with an incumbent contractor who supported the Service and Distribution Center (SDC) with the supply of flags of the United States for interment purposes to the Department of Veterans Affairs (VA). The contractor is responsible for the manufacture, shipment, and delivery of interment flags to VA's SDC warehouse in Hines, IL. Wear-Mark, Inc. d/b/a All Seasons Apparel most recently provided these same supplies to VA under the previous contract. The estimated value of this requirement to support the SDC is $3,921,655.50; $2,613,586.50 for the base period and $654,034.50 for each of the two (2) option periods. 4. Identification of Statutory Authority. The statutory authority permitting other than full and open competition for this acquisition is 41 U.S.C. § 253(c)(5), Authorized or Required by Statute as implemented by FAR Subpart 6.302-5. The applicable statute is Public Law 109-461: "Veterans Benefits, Health Care, and Information Technology Act of 2006," (specifically, the "Veterans First Contracting Program" outlined in 38 USC § 8127(c)). 5. Demonstration of Contractor's Unique Qualifications. Wear-Mark, Inc. d/b/a All Seasons Apparel has provided VA contractual delivery of interment flags for the past five (5) years in support of the Veterans benefits laws mandating a US wholly-made interment flag for use in Veterans' burials. Market research determined that Wear-Mark, Inc. d/b/a All Seasons Apparel is the only Service-Disabled Veteran-Owned Small Business (SDVOSB) manufacturer currently producing Interment Flags. Further, under its previous contract Wear-Mark, Inc. d/b/a All Seasons has consistently met the terms and conditions of the delivery and quality requirements in the assistance of this crucial program. Wear-Mark, Inc. d/b/a All Seasons' Apparel is a SDVOSB with competency in manufacturing, shipping, and delivering textiles, including interment flags and other textiles IAW the NAICS code 314999 All Other Miscellaneous Textile Product Mills. This procurement requires the SDC stock-level of the interment flags to maintain a constant level of ?300,000 flags. Wear-Mark, Inc. d/b/a All Seasons Apparel is able to mobilize immediately and make an initial delivery by June 30, 2012 to assist in maintaining stock levels. Wear-Mark, Inc. d/b/a All Seasons Apparel is also already familiar with VA's processes, standards of flag specifications (tailored), and its important mission to maintain/deliver interment flags as a final benefit to our nation's Veterans. Securing Wear-Mark, Inc. d/b/a All Seasons Apparel to provide continuity will ensure that stock levels are maintained and that interment flags will continue to be delivered timely; thus, enabling the program to continue to be successful in meeting both VA's and the Veterans' needs. Further, as part of the authority to procure using the sole source method, under VAAR 819.7007(c), the Contracting Officer ensured Wear-Mark, Inc. is currently verified as an SDVOSB concern in the VIP database and will re-verify they are in the database at award. 6. Description of efforts made to ensure offers are solicited from as many potential sources as practicable. Consistent with the guidelines of the Veterans First Contracting Program, the proposed action described herein will be synopsized on the Federal Business Opportunities Page in accordance with FAR Part 5. IAW VAAR § 819.7007 Sole source awards to service-disabled veteran-owned small business concerns. (b) The contracting officer's determination whether to make a sole source award is a business decision wholly within the discretion of the contracting officer. A determination that only one SDVOSB concern is available to meet the requirement is not required. 7. Determination of Fair and Reasonable Prices. No award shall be made until the Contracting Officer determines the cost to the Government to be fair and reasonable. This determination will be based on a comparison of current contract pricing, current proposal submissions, other information made available, and the Wear-Mark, Inc. d/b/a All Seasons Apparel proposal. 8. Description of Market Survey. Although extensive market research was conducted in support of VA798S-R-12-0001, the basis for this sole source is for continuity of supplies in the delivery of interment flags in order to maintain SDC stock levels. In accordance with FAR Subpart 6.302-5, a sole source award will be made to Wear-Mark, Inc. d/b/a All Seasons Apparel, an incumbent SDVOSB, for VA's interment flag requirement. In accordance with VAAR § 819.7007(b), a determination that only one SDVOSB concern is available to meet the requirement is not required. 9. Other facts supporting the use of other than full and open competition. None. 10. Listing of Interested Sources. Wear-Mark, Inc. d/b/a All Seasons Apparel 3797 E. Primrose Lane Post Falls, ID 83854 11. Actions Taken to Remove Barriers to Competition. The current (VA798S-12-R-0001) and future interment flag awards are intended to be competitive.
