Description
Justification for Other than Full and Open Competition (JOTFOC) (1) Agency and contracting activity. The United States Coast Guard Command, Control, & Communications Engineering Center (C3CEN), Portsmouth, VA. (2) Action being Approved. Provide services to repair both gear boxes at VTS Valdez remote site Potato Point, Alaska. (3) Description of the Supplies and Services Required. TERMA North America, Inc shall provide 2 each- Flange Oil Trap, 2 each- RJ R100 Encoder Assembly, 1 can each Tribol 800/150, Fittings, small parts and labor for four (4) days. The total estimated value is $46,616.00. (4) Stautory authority permitting other than full and open competition. IAW FAR 6.302- 2(2) When the agency's need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for. (5) Contractor's unique Qualifications TERMA is the only company that can provide the materials and service for this radar repair. TERMA is a piece of equipment proprietary to the PAWSS system. The reason for purchasing the Services from TERMA is to repair the two turning units that are dangerously close to seizing up and resulting in more catastrophic damage to the radar. That damage will result in a complete loss of the turning units and repairs/replacement will be at a substantial cost and time delay for the government. (6) A description of efforts made to ensure that offers are solicited from a many potential sources a practicable. The unusual and compelling urgency of this action precludes synopsis, in accordance with FAR 5.202(a)(2). (7) A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. The Contracting Officer will determine the cost or price negotiated for this contracting action is fair and reasonable prior to award.   (8) Market Research. Market research revealed no other sources can perform the required services. TERMA is the Original Equipment Manufacturer (OEM) of the radar system and technical specifications. TERMA technicians are required to be consulted before proceeding with any action. (9) Any other facts supporting the use of other than full and open competition. The TERMA radar is currently installed throughout the USCG. If the Coast Guard has radars installed and it is deemed a basic part of our VTS configuration, it needs to be operable/function properly. If it does not, it needs to be fixed in a timely manner. With the loss of the radars, the Coast Guard will not be able to meet its mission/operational availability requirements. Each VTS enhances the good order and predictability of vessel traffic by providing clear, concise, accurate, meaningful, and timely advisories to mariners in each Area Of Responsibility (AOR) as defined in Title 33 of the Code of Federal Regulation (CFR), Navigation and Navigable Waters, Part 161 [33 CFR 161]. (10) A listing of sources, if any, that expressed, in writing, an interest in the acquisition. No other sources have expressed a written interest. (11) Actions the agency may take to remove barriers to the competition before any subsequent acquisition for services required. None (12) Contracting Officer's Certification that the justification is accurate and complete to the best of the Contracting Officer's knowledge and belief. I certify this procurement meets the Governments minimum need and that the supporting data, which forms a basis for this justification, is complete and accurate to the best of my knowledge and belief.
