POSTED DATE: 6.12.2012 SUBJECT:Northwest Arctic Harvest Surveys This announcement constitutes the only notice. This is not a request for quotes. A determination not to compete is solely within the discretion of the Government. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. Responses must be received no later than June 15, 2012 by sending an e-mail to Katherine_smiley@fws.gov; however, any technical data received will be for the sole purpose of market research for future requirements. Under Simplified Acquisition Procedures (SAP), Fish & Wildlife Services, Region 7 Contracting and General Services intends to issue a sole source, firm-fixed price order to: COMPANY:Manilaq Association FOR :Coordinate and oversee the collection of data on the subsistence harvest of migratory birds and their eggs in Northwest Arctic villages. Audit the data for correctness and completeness. Return the data (completed survey forms) to the ADFG Division of Subsistence, Anchorage. Collect traditional ecological knowledge on the customary and traditional uses of birds and eggs ON:June 18, 2012 to Feb 8, 2012 NAICS:541690Other Scientific and Technical Consulting AUTHORITY:13.106(b) Soliciting from a single source Determinations not to compete this proposed procurement were made because: The 1997 Protocol Amendment to the 1916 Migratory Bird Treaty between the U.S. and Canada provides for a regulated spring/summer subsistence harvest. The Treaty Amendment lays the legal foundation for the tripartite Alaska Migratory Bird Co-Management Council (AMBCC) consisting of Federal, State, and Native regional partners. The report accompanying the Treaty Amendment specifies the need for harvest monitoring and that harvest information will be collected cooperatively by the AMBCC, including the U.S. Fish and Wildlife Service (USFWS), the Alaska Department of Fish and Game (ADFG), and Native regional partners. The March 28, 2000 Federal Register notice Establishment of Management Bodies in Alaska to Develop Recommendations Related to the Spring/Summer Harvest of Migratory Birds (Volume 65, No. 60) states that annual funding agreements with Alaska Native organizations, ADFG, and others will be used to accomplish harvest monitoring. This Federal Register notice listed the 12 Native regional partner organizations, including the Maniilaq Association (page 16408). Maniilaq has a representative at the AMBCC. The April 8, 2002 Federal Register Notice Procedures for Establishing Spring/Summer Subsistence Harvest Regulations for Migratory Birds in Alaska establishes the program structure for the AMBCC. It states in section (c), Roles and Responsibilities, that the AMBCC will develop recommendations for harvest monitoring and will establish committees to gather and review data. Maniilaq is a non-profit organization that represents the interest of tribes and villages in their region through tribal resolutions that authorize Maniilaq to act in their behalf in matters such as subsistence harvest surveys. Another organization would not have this authority in their region. Maniilaq has conducted subsistence harvest surveys in the Northwest Arctic regions for decades, monitoring harvests of several wildlife and fish species. The structure associated with this work includes contacts and trained surveyors in its member villages and an office in Kotzebue with trained and experienced harvest survey personnel. In addition to the fact that Maniilaq is a regional partner organization of the AMBCC legally charged with gathering the data, it will be more cost efficient to use Maniilaqs existing harvest monitoring system rather than creating a duplicate system. Maniilaq is one of the three organizations that meet circumstance authorized by Statute and Maniilaq and ADFG are the only sources that meet the agency requirement. However, because Maniilaq has the personnel, experience, and expertise in the area, if ADFG were awarded the contract, ADFG would likely subcontract with Maniilaq. Therefore, it is more efficient for the USFWS to contract directly with Maniilaq. The nature of the acquisition requires the use of the authority established by the Treaty Amendment, because the data being provided by the acquisition helps fulfill the requirement that harvest monitoring be conducted cooperatively by the three members of the AMBCC.
