Description
Special Notice It is the intent of the National Archives and Records Administration (NARA) to enter into a firm fixed price purchase order with Eastman Kodak to purchase Kodak film stock. The proposed action will be conducted in accordance with FAR Part 12, Acquisition of Commercial Items. The NAICS code is 334515. The proposed action is for supplies for which the Government intends to solicit and negotiate under the authority of FAR 6.302, only one responsible source and no other supplies or services will satisfy agency requirements. Interested persons may identify their interest and capability to respond to the requirement or submit quotations no later than 12:00 PM EST July 6, 2012. This notice of intent is not a request for competitive quotations. However, all quotations received after the date of publication of this synopsis and prior to 12:00 PM EST July 6, 2012, will be considered by the Government. A determination by the Government not to compete this proposed purchase order based upon responses to this notice is solely within the discretion of the Government. This purchase order will be awarded using simplified acquisition procedures in accordance with FAR Part 13. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The Government will not be responsible for any costs incurred in responding to this notice. IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY, AND SPECIFIC IDENTIFICATION OF THE DOCUMENT AS A "JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION" See Page 1 II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED We are requesting to purchase Eastman Kodak Film Stock for the preservation of the Motion Picture Collection. Purchasing this film stock will not only make it possible to preserve the records, but also to make them accessible for individual researchers and the public at large. Eastman Kodak is the only manufacturer of the particular internegative, duplicating positive, and panchromatic negative film required to work in conjunction with old originals and with other intermediate films in the normal process of film printing. The other two motion picture film manufactures in the world, Agfa and Fuji, do not manufacture comparable laboratory and print film stocks. Substituting other film stocks, even if they existed, would require extensive recalibration of established equipment and processes, would waste considerable time, and would lead to inferior end products. III. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS (INCLUDING THE ESTIMATED VALUE) The following film stock is needed: Kodak 35mm color negative film stock, stock number 8002627 - 22 reels Kodak 35mm 2383 color positive film stock, stock number 1246883 - 36 reels Kodak 16mm 3383 color positive film stock, stock number 8889230 - 18 reels Kodak 16mm 3272 color negative film stock, stock number 8392490 - 50 reels (note: new catalog number for 8392490 is 8002743 for 16mm 3273 color negative film stock) IV. AN IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION. 41 U.S.C. 3304(a)(1) -"Only One Responsible Source" as implemented by FAR 6.302-1. V. A DEMONSTRATION THAT THE PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED. This acquisition meets the authority of FAR 6.302-1 which states that this authority may be used "when the supplies or services required by the agency are available from only one responsible source, or,...from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for." See above II. VI. A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE, INCLUDING WHETHER A NOTICE WAS OR WILL BE PUBLICIZED AS REQUIRED BY SUBPART 5.2 AND, IF NOT, WHICH EXCEPTION UNDER 5.202 APPLIES. A DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE Market research has been conducted to determine whether or not Afga and Fuji products meet NARA's requirements. They do not have the full range of products needed to capture the various types of print and negative types within the collection. Furthermore, the vendor that processes our color film (Colorlab) does not purchase the chemistry needed to develop Agfa and Fuji stocks, nor do they have any plans to begin purchasing this chemistry. If NARA were to purchase Agfa or Fuji stocks we would be required to recalibrate all of our equipment and create additional contracts with additional vendors to have these films developed. VIII. A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED (SEE PART 10) AND THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED See paragraph VI. above. IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION. SEE FAR 6.303-2(a)(9) N/A X.
