Description
This is a notice of intent to award a five year $100,000 capacity sole source Blanket Purchase Agreement (BPA) to Johnson, George Dan (Mr. Johnson) of Apple Valley, CA for the continued provision of highly specialized consulting services for the review, advisory, and consultation of the advisory board of experts overseeing the major seepage repair and rehabilitation projects within the Nashville District, primarily at Wolf Creek Dam and Center Hill Dam. This procurement has been approved for other than full and open competition under the authority of 10 U.S.C. 2304(c)(1), Federal Acquisition Regulation 6.302-1(a)(iii), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The work will require the consultant to review report designs, specifications, and provide input to the district staff on sufficiency of proposed methods to correct the seepage problems. The consultant will provide advice and consultation during the construction phase of these projects. The consultant will also make field visits to the sites with district staff. It has been determined that the Government will incur substantial duplication of costs for the consultant services described above if not obtained by the continued provision of Mr. Johnson. Mr. Johnson has participated with the advisory panels for the past five years and is familiar with the history of these projects. Award to any contractor other than Mr. Johnson to perform the described services would require a substantial amount of time and cost for any other contractor to come up to speed with the advisory panels as it relates to the design and specifications of the proposed remedies. This substantial duplication of effort and its associated cost is not expected to be recovered through competition. It is therefore in the best interests to obtain the services described above by continuing to procure them from Mr. Johnson. The Federal Acquisition Regulations allow for the submission of capability statements from prospective offerors to show interest which shall be considered by the Nashville District U.S. Army Corps of Engineers. This is not a request for capability statements or quotes. However, the Nashville District U.S. Army Corps of Engineers will consider any capability statements or quotes submitted by all responsible sources. Depending on the evaluation result of the capability statements, the Contracting Officer will determine if this sole source action is justified or if a solicitation must be issued to interested firms. A determination by the Government not to compete this requirement based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. No requests for capability briefings will be honored as a result of this notice. Interested sources who submit data are responsible for appropriately marking information if it is proprietary in nature. If potential offerors choose to submit information, past performance and references regarding capability to perform these services must be provided along with the statement of capability. The Government will not award a contract based on the information received, nor reimburse participants for information they provide. Information provided is strictly voluntary.
