Description
Justification for Other Than Full and Open Competition - Simplified Acquisition This Notice of Intent is NOT a Request for Quotation (RFQ) for competitive quotes; however, in accordance with FAR Part 13 and Part 6.302-1, the Federal Emergency Management Agency (FEMA) intends to award a sole source delivery order based on the authority of FAR 6.302-1 "only one responsible source and no other supplies or services will satisfy agency requirements". FEMA intends to award this delivery order to Textron, Inc., c/o Werres Corporation for the purchase of two Cushman Shuttle/Bellhop # 6E carriers and one Cushman Titan Model 634. These products are considered commercial items in accordance with FAR Part 2. This action is being performed in accordance with FAR 13.106-1(b)(1) which states, "For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available". A Justification for Other Than Full and Open Competition has been approved by the Contracting Officer and is provided as an attachment to this notice. Two Cushman Shuttle/Bellhop # 6E carriers and one Cushman Titan Model 634 are needed by DHS, FEMA, MWEOC to move people, tools and supplies throughout the facility. MWEOC has standardized its' fleet of electric vehicles by utilizing Cushman products. This standardization eliminated the need to stock spare parts for several manufacturer products which saves valuable warehouse space. It also removed the need to train personnel to use different brands of electric vehicles which promotes familiarity and ease of use. The Cushman Dealer who provides these electric vehicles must be within a 50 mile radius of MWEOC in order to ensure repairs and/or servicing of these vehicles can be completed quickly and that warranties are honored. Werres Corporation in Frederick, MD is believed to be the only Cushman dealer within a 50 mile radius of MWEOC; however, any Cushman dealer located within a 50 mile radius of zip code 20135, and capable of providing the required products, is requested to contact Phyllis Woodward via email at Phyllis.Woodward@fema.dhs.gov or by fax to 540-542-2631, no later than 4:00 PM on July 6, 2012. Capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination not to compete this proposed procurement based on responses to this notice is solely within the discretion of the Government.
