- AMENDMENT NOTICE:This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice.The solicitation number is 10692A1551 and is issued as an invitation for bids (IFB), unless otherwise indicated herein.The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-58. The associated North American Industrial Classification System (NAICS) code for this procurement is 321999 with a small business size standard of 500.00 employees.This requirement is a [ Small Business ] set-aside and only qualified offerors may submit bids.The solicitation pricing on www.FedBid.com will start on the date this solicitation is posted and will end on 2012-06-27 16:00:00.0 Eastern Time or as otherwise displayed at www.FedBid.com.FOB Destination shall be SPRINGFIELD, VA 22153 The Department of State requires the following items, Purchase Description Determined by Line Item, to the following: LI 001, Outer Dimesions 42"x22"x27" Lead lined Crates All with 3/8" CDX plywood with 1 x 3 cleats (or battens) Set-up with nails or screws. It is technically acceptable to just line each flat panel with lead on the inside and then assemble the container, 100% coverage of lead on the inside of each panel is required. Outside of the box (all sides)and runners or skids are covered with plastic backed burlap (360 coverage) w/ the burlap on the lid overlapping 5 inches to drape sides (2 millimeter Polyurethane Backing)., 60, EA; LI 002, Outer Dimesions 36"x22"x27" Lead Lined Crates All with 3/8" plywood with 1 x 3 cleats (or battens) Set-up with nails or screws. Questions not received within a reasonable time prior to close of the solicitation may not be considered.*** For this solicitation, Department of State intends to conduct an online competitive reverse auction to be facilitated by the third-party reverse auction provider, FedBid, Inc. FedBid has developed an online, anonymous, browser based application to conduct the reverse auction. An Offeror may submit a series of pricing bids, which descend in price during the specified period of time for the aforementioned reverse auction. Department of State is taking this action in an effort to improve both vendor access and awareness of requests and the agency's ability to gather multiple, competed, real-time bids.All responsible Offerors that respond to this solicitation MUST submit the pricing portion of their bid using the online exchange located at www.FedBid.com. All offerors must submit literature and pictures of the line items offered to support claims made in their respective offer. The literature provided can be a brochure of the company along with the details of the make up of the crate offered so we can review to ensure technical sufficiency with the requirement. Picures must be submitted with offer demonstrating detail similiar to the sample pictures provided on this notice for offerors. If any offer does not provide this information they will not be given further consdideration for this requirement. Any partial or incomplete responses will be considered technically unacceptable and will not be considered for award. Agencies may require registration with the Central Contractor Registry (CCR) prior to receipt of order, pursuant to FAR 4.1102 and other applicable regulations and guidelines. Information can be found at www.ccr.gov. All Bids must be valid for 30 days from the closing date for this solicitation. No exceptions or qualifications. New equipment ONLY, NO grey market or refurbished products. Items must be in original packaging, never used, and not altered in any way. Components of the requested equipment, to include memory, must be manufacturer-approved and may not be compatible, remanufactured, or refurbished equipment. All items must be covered by manufacturer's warranty and procured through a manufacturer approved distribution channel. Sellers must be able to document their ability to provide items through manufacturer approved distribution channels upon request. The Seller confirms to have sourced all products submitted in this Bid from manufacturer-approved channels for Federal sales, in accordance with all applicable laws and manufacturer's current applicable policies at the time of purchase. Seller must be able to support both the product sale and product pricing, in accordance with applicable manufacturer certification / specialization requirements. If software is provided or included, Seller shall, upon request, provide Buyer with a copy of the End User License Agreement. Seller certifies that all software is licensed originally to Buyer as the original licensee authorized to use the software. All bid prices must include shipping FOB Destination CONUS (CONtinental U.S.). Partial shipments are required, unless otherwise specified by Contracting Officer at time of award. The Contractor and its employees shall exercise the utmost discretion in regard to all matters relating to their duties and functions. They shall not communicate to any person any information known to them by reason of their performance of services under this contract which has not been made public, except in the necessary performance of their duties or upon written authorization of the Contracting Officer. All documents and records (including photographs) generated during the performance of work under this contract shall be for the sole use and become the exclusive property of the U.S Government. Furthermore, no article, book, pamphlet, email, recording, broadcast, speech television appearance, film or photograph concerning any aspect of work performed under this contract shall be published or disseminated through any media without the prior written authorization of the Contracting Officer. These obligations do no cease upon the expiration or termination of this contract. The Contractor shall include the substance of this provision in all contracts of employment and in all subcontracts hereunder. The selected Offeror must comply with the following commercial item terms and conditions. FAR 52.212-1, Instructions to Offerors - Commercial, applies to this acquisition. The selected Offeror must submit a completed copy of the provision at 52.212-3, Offeror Representations and Certifications - Commercial Items. FAR 52.212-4, Contract Terms and Conditions - Commercial Items, applies to this acquisition. The following FAR clauses in paragraph (b) of FAR clause 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, will apply: 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.225-13, 52.232-34. The full text of a FAR clause may be accessed electronically at http://www.acqnet.gov/far. Offerors will be evaluated based on offered Lead Lined Crates meeting or exceeding the requirement when compared to the specifications listed in the line items. The Government reserves the right to make determinations on technical acceptability of the requirement meeting or exceeding the need based on the description, literature and pictures offered in support of the offer. Technical acceptability of meeting or exceeding the requirement, past performance as demonstrated on Fedbid.com or other past performance databases, and adherence to the delivery requirements are all more important than price. Delivery schedule is a factor for evaluation and each offeror must make their best business judgement in the offer based on the requirement and their ability to meet or exceed the requiremenet. The Government prefers fifteen days. There will be no advance payment or financing options available for this requirement. First article submissions prior to delivery of all requirement after award are acceptable and will be worked out with the awardee and end-user if requested by offeror or the Government on the day of award. The Government may increase the quantity of supplies at the agreed upon unit price. The Contracting Officer may exercise the option by written notice to the Contractor within 180 days. Delivery of the added items shall continue at the same rate as the like items called for under the agreement, unless the parties otherwise agree. Offerors are required to follow the below structure for providing partial shipment delivery schedule in relation to shipment costs, which is subject to change and not definite. The end user cannot accept one-time shipments, as there is limited space to store all of the crates; for each shipment, the type and quantity of crates will change depending on need. Each shipment type and quantity will be finalized between the end user and awardee, and delivery will be expected to be around 15 days from being contacted by the end user. Offerors are expected to be flexible and work closely with the end user. However, for the purposes of evaluating offeror?s technical ability to follow instructions and provide understanding of delivery schedule, offerors will use the below indentified structure and provide shipping costs, based on the revised lay out. Structure for including shipping costs in the offer (NOT DEFINITE BUT SHOULD BE QUOTED): --There are 12 total shipments-- - Shipments 1-11 will include the following types and quantities of crates (based on line items of the solicitation)---Line Items: 001-008; Quantities Respectively: 5, 5, 3, 17, 9, 9, 9, 3 - Shipment 12 will include the following types and quantities of crates (based on line items of the solicitation)---Line Items: 001-008; Quantities Respectively: 5, 5,2, 13, 1, 1, 1, 7 Prior to award the Government reserves the right to obtain a one (1) sample crate from any offeror to assist in determining technical adherence. All costs associated with providing a sample crate prior to award will be borne by contractor. The Government will not reimburse any costs associated with receiving this sample crate.
