- 1.Contracting Activity: Department of Veterans Affairs, VISN 1, 689 Medical Center 689-12-6405-0002 2.Nature and/or Description of the Action Being Processed: This is for the sole source procurement of a firm fixed price contract with Standard communication to purchase PBX equipment for the new Willimantic leased space and the Vet Center expansion. This order will not exceed $250,000 and has a IGE of $222,000. 3.Description of Supplies/Services Required to Meet the Agency ™s Needs: The VA is opening a new CBOC in Willimantic and has a planned expansion of the Vet Center. In order to eliminate the sole source contract; the only provider of plain old telephone lines (POTS) in CT the VA OIT office decided this would be the best time to migrate both of these locations to PBX phone systems. VISN 1 currently has a Task Order in place for Standard communication to maintain the entire PBX systems network wide. However only the installation of the equipment is covered under Standard communications GSA contract. This requirement has an equipment cost that is expected to be $209,500, and labor is incidental to the equipment purchase. The CT VA currently still has their PBX system under warranty with Standard Communication. If another contractor was to come in and provide the equipment or installation that warranty would be voided costing the government thousands in service repairs. 4.Statutory Authority Permitting Other than Full and Open Competition: ( x ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor ™s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Standard Communication currently hold the warranty and the VISN wide maintenance contract for the PBX system. If another contractor was allowed to supply the equipment or the installation that warrant would be voided, and Standard Communication would no longer be held responsible for any failure of the system under the VISN wide GSA Task Order, as they would not be the only contractor accessing the system. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: No efforts were made to compete this requirement as that would void the warranty of the VACT system. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The CO has compared the prices on the IGE with the price of similar items on GSA contract. If all items to be purchased were obtained from the GSA contractors the cost would be $106,000 more than it is anticipated to be purchasing through Standard Communications due to the discount they apply to all government purchases. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted for pricing reasonableness only due to the warranty and VISN wide TO. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: This procurement will eliminate a portion of the annual sole source with the AT&T SNET. This will allow for an increase in competition for the telephonic requirements annually. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: See Section VI above. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: This is a onetime procurement. The CO working the PBX contract will address adding the purchase of equipment to that contract to eliminate that requirement to do a sole source for each equipment purchase. 12.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
