LIMITED SOURCE JUSTIFICATION •1. IDENTIFICATION OF AGENCY AND CONTRACTING OFFICE Agency: Social Security Administration (SSA) Contracting Office: Office of the Deputy Commissioner for Budget, Finance and Management; Office of Acquisition and Grants (OAG) Contracting Officer: Madeline Bryant (410) 965-9464 Program Office: Office of the Deputy Commissioner for Systems; O ffice of Telecommunications and Systems Operations (OTSO); Division of Resource Management and Acquisition Contracting Officer's Technical Representative (COTR): Title: Maintenance Services for Hewlett-Packard (HP) Servers Proposed Contractor(s): HP or Resellers of HP Hardware and Software Maintenance •2. NATURE OF ACTION The action to be approved is a Brand Name Justification for maintenance on SSA-owned HP servers for a firm-fixed-price (FFP), commercial services delivery order. Quotes will be obtained from HP and authorized resellers of HP maintenance services under the General Services Administration (GSA) Federal Supply Schedule (FSS) contracts. •3. DESCRIPTION OF SERVICES AND ESTIMATED COST Estimated Cost: $215,000.00 Period of performance: 07/01/2012 to 06/30/2013 The agency plans to award a contract for the purchase of hardware and software maintenance on government-owned HP Itanium servers. The OTSO Hewlett-Packard UNIX (HP-UX) server infrastructure that supports Oracle is built exclusively on the HP Itanium servers running HP-UX operating system. They are used to support the paperless project in the National Computer Center (NCC), Second Support Center (SSC), and Remote Operation Communication Centers (ROCCs). The HP servers contain the Integrated Human Resources System (IHRS) used to maintain employee records, Disability Case Adjudication and Review System (DICARS) used to track disability folders while a claim is being processed, and Reengineered Disability System (RDS). The databases residing on the hardware are Paperless - Program Service Center, Processing Center Action Control System (PCACS), and DICARS. OTSO requires HP Support Plus 24, which includes 24x7x365 onsite and remote hardware and software maintenance services. Hardware maintenance includes onsite support with 4-hour response time and all parts/materials to repair or replace components or entire units as necessary. Software support includes problem-analysis and problem-resolution by telephone within 2 hours of the call being logged along with technical support, electronic support and updates. •4. AUTHORITY AND JUSTIFICATION RATIONALE The MAS Program (see Federal Acquisition Regulation (FAR) 8.401). The rationale for this justification is FAR 8.405-6(b) (3) - The item is peculiar to one manufacturer (brand name item). Only HP and its resellers are capable of meeting SSA's needs. HP does not have authorized maintenance providers for HP systems under warranty or running their proprietary HP-UX operating system. Having a third party vendor repair any parts of the server will cause the warranty to become null and void, requiring SSA to assume the cost of the maintenance for the parts that would otherwise have been under warranty. HP software support provides the License-To-Use patches, updates and new releases of HP-UX operating system and software and is proprietary to HP. Customers under the purview of an HP Hardware/Software agreement are licensed to use such patches and revision updates, as well as entitled to the distribution and use of new revisions. No software support, including Right-To-Use licenses for patches, updates and new releases are available outside of an authorized HP Support Agreement. HP has service technicians trained and original equipment manufacturer (OEM) certified to work on HP Itanium servers running HP-UX operating system. There are no other vendors that have OEM certified technicians trained to service HP Itanium servers and their internal parts. Only HP can provide: •- Nationwide direct 24x7 access to full service maintenance coverage for HP Itanium servers, •- Nationally organized dealer network with OEM certified technicians trained on all HP models and OEM - HP parts, •- Onsite support with 4-hour response time to bring HP systems back on line, •- Technician access to local HP depots to acquire parts to resolve any hardware problems, •- Parts and supplies that are new or certified like new, and •- Right-To-Use updates, fixes and patches for the HP-UX operating system. •5. DETERMINATION OF BEST VALUE The Contracting Officer will perform applicable and appropriate price evaluation as required by FAR 8.405-2(d) to determine that the order represents the best value consistent with FAR 8.404(d) and results in the lowest overall cost alternative to meet the Government's needs. In addition, as provided in FAR 8.404(d), GSA has already determined the prices of supplies and fixed-price rates for services offered at hourly rates under FSS contracts to be fair and reasonable. •6. MARKET RESEARCH CONDUCTED Brand Name Market Research: After speaking with HP personnel and SSA end-users, these servers require a maintenance provider that delivers a consistent level of quality service. Having a third party vendor repair any parts of the server will cause the warranty to become null and void, requiring SSA to assume the cost of the maintenance for the parts that would otherwise have been under warranty. No vendor other than HP can provide support addressed in the Authority and Justification Rationale section above. Resellers Market Research: There are multiple authorized resellers of HP maintenance, including: Northrop Grumman, GTSI, Lockheed Martin, SAIC and Raytheon. However, the actual delivery of service for HP-UX is always delivered directly by HP. •7. OTHER SUPPORTING FACTS HP has successfully provided warranty and maintenance services on these systems for 15+ years since the original purchase of servers running HP-UX. •8. REMOVING OR OVERCOMING BARRIERS See the information presented in Section 6 above regarding market research. Although the agency will solicit the number of quotes required by FAR 8.405-2, for reasons explained in Section 4 above, quotes will only be solicited from resellers of the brand name HP. If a new CCS is implemented in the future, the agency will ensure that acquisition of a new system and software will meet the requirements of FAR 8.405-2.
