- Justification for Other Than Full and Open Competition This is a combined synopsis/solicitation for the Sole Source of a commercial item prepared in accordance with the format in FAR 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. a. Solicitation number HQ003021710004 is being issued as a Request for Quotation (RFQ) b. Provisions and clauses are those in effect through both Federal Acquisition Circular (FAC) 2005-58 effective 18 May 2012 and DFARS DPN 20120629. c. The North American Industrial Classification System (NAICS) code for this procurement is 512120, "Motion Picture & Video Distribution", with a small business standard of $29.5 million. d. DESCRIPTION: Television programming as follows: CLIN 0001: a) American Idol (Yr 12)/55 Episodes/Run Time: 60 minutes/Term: 1-Yr & 2-Runs, and b) The X-Factor (Yr 2)/43 Episodes/Run Time: 60 minutes/Term: 1-Yr & 2-Runs. Delivery: 18SEP2012. AFN will distribute the programming by encrypted, digitally compressed satellite transmission system (currently Cisco's PowerVu Plus (MPEG-4)) and/or by mail to authorized AFN television outlets outside the contiguous United States for their non-commercial distribution/presentation via television broadcast frequencies, encrypted, digitally compressed satellite transmission, and/or limited closed-circuit distribution systems. e. Delivery and acceptance will be made at: American Forces Nework - Broadcast Center (AFN-BC) 23755 Z Street Riverside, CA 92518-2031 f. FAR Provision 52.212-1 (Instructions to Offerors - Commercial Items) (Feb 2012) applies to this acquisition. Para (k) requires current registration in the Central Contractor Registration (CCR) database at http://www.ccr.gov. g. The Government intends to award a Firm Fixed-Price Purchase Order as a Sole Source Procurement to contractor Fremantle Media, Ltd, London, England in accordance with 10 U.S.C. 2304(c)(1) & FAR Part 6.302-1 (Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements) for their exclusive rights television programming. The Justification for Other than Full and Open Competition is attached. h. Quotations must include completed copy of FAR provision FAR 52.212-3 (Offeror Representations and Certifications - Commercial Items) (Apr 2012), Alt 1 (Apr 2011) or indication that reps and certs are in ORCA. i.
