Description
THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent to award a sole source contract under statutory authority Section 4202 of the Clinger-Cohen Act of 1996 as implemented by FAR 13.501(a), "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." United States Special Operations Command (USSOCOM), 7701 Tampa Point Blvd, Tampa, FL 33621, renewal of support and upgrades to the Task Management Tool currently in use by USSOCOM. The 6th Contracting Squadron intends to make an award to Accenture Federal Services, 11951 Freedom Dr, Suite 1000, Reston, VA 20190. Interested parties may e-mail leyla.campbell@us.af.mil, not later than 01 August 2012 by 2:00 PM EST. V. DEMONSTRATION THAT THE CONTRACTORS UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) Accenture Federal Services developed the TMT software and is the only company that maintains the software. TMT is a custom solution which adds to and leverages a number of existing Microsoft technologies. The implementation of the TMT requirements represents a combination of deep product configuration and some custom components to address customers' requirements. Accenture developed the TMT capabilities and the TMT application is proprietary to Accenture. Accenture TMT capabilities are uniquely customized and require specific network configurations that only Accenture is able to provide. The current contract included installation, training, and licenses. In a letter dated 29 June 2011, Accenture stated: "Accenture is the sole developer of TMT, and the application is and remains proprietary to us. After our current contract with SOCOM ends, we will have no obligation to deliver any code fixes or new TMT features to SOCOM. Nor are we obligated to deliver our source code to any other company". In addition, $1,950,000 has been invested in the Task Management Tool throughout USSOCOM. The customer estimates it would take approximately seven months to test and field a new product to include training individuals to use a new system. This would result in an unacceptable loss of productivity while individuals are trained to use a new system and downtime due to installing and testing a new system. This is a follow-on contract and installing an entirely new system would result in substantial duplication of cost to the Government that is not expected to be recovered through competition and would result in unacceptable delays. The Government has already paid to install, test, and train individuals on TMT.
