Description
Moakley Fire Event Repair EMCOR Justification (Other than Full and Open Competition) SIGNED 7-5-12 This notice is being posted in reference to a sole-source Task Order Number GS-P-01-12-BW-5150, issued under Contract Number GS-01P-07-BW-D-0063 for Commercial Facility Management Services at the Moakley United States Courthouse, Boston, Massachusetts, with EMCOR Government Services. The subject Task Order, issued on May 30th, 2012, was executed in response to an explosion and fire in the electrical switchgear room of the Moakley United States Courthouse that occurred on May 24th, 2012. This work was undertaken on an emergency basis in order to restore building electrical systems and fire /life safety equipment essential to the opening and continued operation of the Courthouse. Due to the nature of the emergency, an immediate response was required to prevent possible loss of life and additional damage to the asset itself. In accordance with approved Regional emergency procurement procedures, the Contractor was given the Notice to Proceed on May 25th, 2012, and a subsequent Task Order issued on May 30th, 2012, that incorporated the final definitization schedule. The referenced Delivery Order was based upon the contemporary assessment of the amount and nature of the needed emergency work, and with the intention of posting the required justification within 14 calendar days in accordance with FAR 6.305. However, in the interim, the technical assessment of the nature and extent of the damage changed, and additional potential issues were identified that warranted further investigation in order to ensure that the risk of short-term recurrence was mitigated, and the Building's steady operational state preserved. Due to these changes, the estimated amount of the contract correspondingly increased, to the degree that additional review and approval thresholds, including the approval of the Regional Head of Contracting Activity, were required to be satisfied. As these levels of review and approval were neither envisioned, nor triggered, by the original technical assessment of the conditions at the time of award, they could not be completed and satisfied within the posting time required by FAR 6.305.
