- This is a Sources Sought Notice Purpose The Defense Freedom of Information Policy Office, Executive Services Division, Washington Headquarters Services, is requesting information to determine sources sought with demonstrated experience and ability to provide FOIA litigation support. Objective The objective is to obtain information about suppliers that: 1. Can provide technical and implementation support to DFOIPO in its processing of documents all Freedom of Information Act (FOIA) lawsuits for the OSD/JS, and providing litigation support and assistance, when requested by DoD Office of General Counsel (OGC), to other DoD Components. 2. Provide general support consisting of the following: draft, initiate, task, and reconcile FOIA litigation taskings to DoD Components and other Federal agencies; to produce indices of responsive documents and withheld information, as required by Vaughn v. Rosen, 484 F.2d 820; to draft and coordinate proposed declarations for FOIA litigation to be signed by the appropriate government officials; to coordinate all taskings and correspondence with the Department of Justice (DoJ) and the OGC; and to manage the review process of these litigation taskings. Background Information The fundamental concept underlying this contract support effort is the decision for final release of Federal Government documents/information, classified and official, which resides solely with the Government chain of inspection, in accordance with the FOIA and applicable DoD Regulations. The cases on this effort are strictly at the litigation stage. Contract FOIA Analysts, accordingly, can only assist in the processing of litigation casework by conducting coordination, research, and information release recommendations as part of a four step approval process. The contracting personnel will consist of one Team Lead, to oversee the everyday workings of the contract personnel, as well as processing litigation cases. In addition to the Contract Lead, four Senior FOIA Analyst, four Junior FOIA Analyst, and three Administrative Personnel will make up the rest of the FOIA team. Requirements: RFI responses must include: 1. Name of the primary point of contact 2. Business title 3. Email address 4. A brief summary description of relevant experience and ability to provide FOIA litigation support that meet the aforementioned objectives. 5. Describe any Government contracts in detail (contract number, contract type, contract value, description of scope, name and contact information for contracting officer, name and contact information for contracting officer's representative) providing FOIA support. THE GOVERNMENT DOES NOT INTEND TO AWARD A CONTRACT ON THE BASIS OF THIS RFI OR REIMBURSE ANY COSTS ASSOCIATED WITH THE PREPARATION OF RESPONSES TO THIS RFI. This RFI is issued solely for information and planning purposes and does not constitute a solicitation. All information received in response to this RFI marked Proprietary will be handled accordingly. Responses to the RFI will not be returned. Whatever information is provided in response to this RFI will be used to assess tradeoffs and alternatives available for determining how to proceed in the acquisition process for the Information Technology Research Membership Licenses. In accordance with FAR 15.201(e), responses to this RFI are not offers and cannot be accepted by the Government to form a binding contract.
