- This contract action was accomplished using other than competitive procedures because there is only one responsible source as this was an unsolicited research proposal, and no other supplies or services will satisfy agency requirements.(FAR 6.302-1). See posted J&A for further information. JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. Contracting Agency: Department of the Army, Corps of Engineers, Savannah District, 100 West Oglethorpe Ave., Savannah, GA 31402-0889. 2. Description of Action: Simplified Acquisition Purchase ofCocl-OX Technology from DeepEarth Technologies. Inc. for chemical oxidation remediation of the Underwater Storage Tank (UST) site located adjacent to Building 2485 at Lawton Airfield, Fort Benning, GA. Type of funds: Installation Restoration Program 3. Description of Supplies/Services: Purchase of Cool-OX Technology for site remediation. The value of this purchase is $36,984.00. 4. Authority Cited: The statutory authority permitting other than full and open competition is 10 U.S.C. 2304 (C)(I) as implemented by FAR 6.302-lc, only one responsible source and no other Supplies/Services will satisfy Agency Requirements. 5. Reason for Authority Cited: A Corrective Action Plan was approved by GAEPD and chemical oxidation will be employed to reduce the remaining product at the site. Most chemical oxidation levels generate significant heat during the oxidation process. Due to the shallow nature of the groundwater and the close proximity of Building 2485, its generator and assorted wiring, Fort Benning wishes to use a chemical oxidation product which does not generate significant levels of heat. Cool-OX Technology meets this requirement. Failure to conduct the approved corrective action may result in injury to the Government through potential regulatory issues and fines. 6. Efforts to Obtaio Competitioo: Only one (I) supplier has been identified that meets all the requirements of the installation. The Cool-OX patented technology, by DeepEarth Technologies, Inc., is the only known technology at this time that will meet the temperature requirement. In addition, the suppliers of the Cool-OX Technology employ a patented injection system, Hydrodart, which allows the injection of the Cool-OX product around very tight areas such as the generator and electrical wiring that connects the generator to Building 2485. 7. Actions to Increase Competition: Cool-OX Technology is a specialized product developed for very specific use. Most common remediation technologies are available through a wide variety of sources; however, this particular technology is not. The use of this technology is for the specific purpose of low temperature chemical oxidation in an area where the generation of significant heat during a nonnal process is a legitimate concern of the client. 8. Market Survey: The Government's technological remediation needs can typically be met by those that are customarily available in the commercial marketplace; however, only one (I)supplier, DeepEarth Technologies, Inc., has been identified that meets all the requirements of the installation, Fort Benning. The cost for purchasing this technology for this site is considered fair market price. 9. Interested Sources: A CBD notice will not be published. 10. Other Factors: Purchase of standard chemical oxidation technologies other thaa the Cool-OX Technology for this site would not be in the best interest of the Government, and could potentially result in regulatory issues and fines should the implementation of the technology not be allowed to proceed.
