- The U.S. Environmental Protection Agency (EPA), Office of Acquisition Management (OAM) intends to award a sole source, fixed-price, purchase order for the Office of Chemical Safety and Pollution Prevention (OCSPP), Office of Pollution Prevention (OPP), Biological & Economic Analysis Division (BEAD), Analytical Chemistry Branch (ACB) under the authority of FAR Part 13.106-1(b)(1), to Waters Corporation (Waters) in order to procure a service plan renewal for the existing Waters Xevo TQ LC/MS/MS System. The purpose of this procurement is to obtain a Total Assurance Plan (TAP) with one (1) Performance Maintenance (PM) visit for Waters Quattro Premier MS/MS detector, Acquity liquid chromatograph (LC) components, and the MassLynx Software one (1) year plan for the LC/MS/MS system. This service plan covers all components of the LC system (UPLC TUV Detector, UPLC Sample Manager, and UPLC Binary Solvent Manager) as well as the Quattro Premier MS/MS detector. The TAP is a comprehensive service agreement that includes: all corrective maintenance and one (1) PM visit in which a trained engineer will replace all parts subject to wear (specified in agreement). TAP customers receive top priority response time for all visits and all part used in corrective maintenance and PM visits are guaranteed and factory-tested. The agreement will cover the following existing equipment from August 2, 2012 to August 1, 2013: Equipment Serial Number MassLynx SoftwareMS3EN01770 UPLC Binary ManagerB05UPB651M UPLC Sample ManagerB05UPS593N UPLC TUV DetectorB05UPT283M Quattro Premier AssyVAA258 The ACB uses this system to evaluate analytical methods of detecting pesticide residue in food and fibers to ensure the enforcement of legal residue limits. ACB is currently working on several priority projects that require the continued and timely maintenance of the equipment. For this reason, it is imperative that there be no laps in service between the current service agreement ending August 1, 2012 and the new contracted agreement. Waters is the only known holder of the licenses, patent and copy rights to the equipment and software used in the LC/MS/MS system. For this reason Waters is the only know source that can provide the required maintenance for both the hardware and software on the above mentioned system. NO SOLICITATION FOR QUOTES IS AVAILABLE FOR THIS PROCUREMENT. Notwithstanding, any firm that believes it is capable of meeting the requirements as stated herein, may submit a firm fixed price quote by 1:00 PM ET on Monday, July 23, 2012 for consideration. A determination not to compete the purchase order based upon the responses to this notice is solely within the discretion of the government. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the government.
