MAIN ST, CHURUBUSCO, IN, 46723. This acquisition is for the procurement of 160(ea) Ultra High Threat Houston Barricades. Delivery will be through Defense Distribution Depot San Joaquin Tracy Depot, CCP WHSE. 30, 25600 South Chrisman Road, Tracy, CA 95376-5000 The statutory authority for other than full and open competition is 10 U.S.C. 2304 (c)(1), Statutory FAR 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements (b) Application (1) When there is a reasonable basis to conclude that the agency's minimum needs can only be satisfied by -- (ii) For DOD, NASA, and the Coast Guard, unique supplies or services available from only one or a limited number of sources or from only one or a limited number of suppliers with unique capabilities. - and - (2) The existence of limited rights in data, patent rights, copyrights, or secret processes; the control of basic raw material; or similar circumstances, make the supplies and services available from only one source (however, the mere existence of such rights or circumstances does not in and of itself justify the use of these authorities) (see Part 27). Interested firms may identify their interest and capability to respond to the requirement by submitting clear evidence of their capability to provide/perform. The resultant contract will be a firm fixed price purchase order. The NAICS code is 325211 for this procurement. This notice of intent is not a request for competitive proposals. All responses must be received within 5 business days of publication of this synopsis to be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government.
