- JUSTIFICATION AND APPROVAL (J&A) FOR OTHER THAN FULL AND OPEN COMPETITION 1. The Office of Acquisition Management is conducting this acquisition for Iridium Satellite Phone Service. The estimated cost is $32,653.24. 2. Nature and/or description of the action being approved: This is a request for the renewal of the current Iridium contract. The Iridium phones are used in high-threat areas) on behalf of the Department of State's Bureau of Conflict Stabilization Operations (CSO) and inter-agency's. CSO is the lead for this interagency initiative. 3. A description of the supplies or services required to meet the Department's needs. These phones are currently in use in the field. In order to get keep these phones working and not expire on July 28, 2012 they need to have a voucher, which contains minutes, loaded onto them. The SIMS cards that are already loaded in the phones are registered to Segovia so they would be the only ones that could add additional vouchers to those SIMS cards. It is currently the cheapest option for CSO. If we do not go with Segovia we will also have the cost of new SIM cards and mailing these cards to individuals currently in theatre. Renewing the current contract is the best option. 4. An identification of the statutory authority permitting other than full and open competition. The statutory authority permitting other than full and open competition is 41 U.S.C. 253 (c)(1). The regulatory authority is FAR 6.302-1 - Only one responsible source and no other supplies or services will satisfy agency requirements, Circumstances Permitting Other Than Full and Open Competition for the purposes of supporting U.S. national security interests as listed in NSPD-44. 5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. The requirements for these Satellite phones are unique and sensitive in nature and will become part of the individuals Evasion Plan of Action (EPA). Department of State/Diplomatic Security and the military are using the Iridium phones in the field to communicate with CRC personnel who have these phones in their possession. The satellite phones must be carried by CRC personnel at all times while deployed in non-permissive environments. Without proper equipment agency personnel's defensive posture becomes seriously in danger. 6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. GSA Advantage carries commercial vendors capable of giving us a contract similar in nature however, it would require that we not only purchase new SIM cards but also mail them to our CRC members who are in the theatre, and some currently embedded. Which would require extreme logistical moves to get the new SIMS cards out into the field. The current option only requires programming. 7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. The cost of the service is comparable to other companies offering the same service however, the cost savings of not having to purchase new SIM cards and deliver them to various countries renders other contract mute. 8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted. If different satellite phones from different vendors are procured because the contract must be competed every time an order is placed, uniformity for the CRC will not be achieved. Consequently, CRC training courses will need to be adjusted to accommodate training on satellite phones 9. Any other facts supporting the use of other than full and open competition. If CRC members deploy without the proper communications equipment and require satellite phones be sent to them mid-mission because the security situation on the ground changes; they must be sent a model they are familiar and comfortable with. Lastly, training on, issuing, and accounting for multiple satellite phones makes and models will increase the economic costs to the U.S. Government and unnecessarily waste work-hours in the long-run. This will allow for continuity of operations. 10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition. None were contacted due to nature of the requirement. 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. Include a statement that this J&A for other than full and open competition will be published on FedBizOpps in accordance with FAR Section 6.305 within 14 days of award (or within 30 days if the J&A is for unusual and compelling urgency.)
