This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The Solicitation number is 12-233-SOL-00571 and is being issued as a request for proposal (RFP). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-58, effective May 18, 2012. Offers will only be considered from States, Territories, Indian Tribes and Tribal Organizations, public agencies, and private nonprofit organizations as authorized by the Low Income Home Energy Assistance Act of 1981 (Title XXVI of Public Law 97-35, as amended, 42.U.S.C. 8621), in Section 2609A(a). Offerors should be registered in the Central Contractor Registration (CCR) database. The North American Industry Classification (NAICS) Code is 541690. The small business size standard is $14M. A Firm Fixed Price contract is anticipated. The period of performance has a base period of 12 months with one (1) 12 months option period. The Low Income Home Energy Assistance Program (LIHEAP) is a block grant authorized by the Omnibus Reconciliation Act of 1981 (OBRA), as amended, and administered within the Department of Health and Human Services (DHHS). In DHHS, LIHEAP is administered by the Division of Energy Assistance within the Office of Community Services (OCS), which is a part of the Administration for Children and Families (ACF). The purpose of LIHEAP is to provide grants to LIHEAP grantees (States, Territories, and approximately 140 Indian Tribes and Tribal organizations) to assist low income households in meeting the costs of home energy. Section 2609A(a) of the Low Income Home Energy Assistance Act of 1981 (title XXVI of Public Law 97-35, the Omnibus Reconciliation Act of 1981, 42 U.S.C. 8621, as amended), authorizes the Secretary of the Department of Health and Human Services to set aside up to $300,000 each fiscal year to make grants to State and public agencies and private nonprofit organizations; or to enter into contracts or jointly financed cooperative arrangements with States and public agencies and private nonprofit organizations, to provide training and technical assistance related to the Low Income Home Energy Assistance Program (LIHEAP). The Consolidated Appropriations Act, Public Law 112-74 (2011) appropriated $3.4 billion for the FY 2012 LIHEAP program and included the following additional provision: "Provided further, That notwithstanding section 2609A(a), of the amounts appropriated under section 2602(b), not more than $3,000,000 of such amounts may be reserved by the Secretary for technical assistance, training, and monitoring of program activities for compliance with internal controls, policies and procedures." The Contractor shall be responsible for providing administrative support and assistance to (a) convene LIHEAP training webinars and podcasts; (b) develop training modules and toolkits for grantees of the Low Income Home Energy Assistance Program (LIHEAP); and (c) convene one, two-day LIHEAP grantee training workshops. This acquisition is being conducted using Part 12 of the Federal Acquisition Regulation. The provision at 52.212-1, Instructions to Offerors-Commercial, applies to this acquisition. Provision at 52.212-2, Evaluation-Commercial Items, is applicable. Evaluation of proposals will be conducted in accordance with the criteria identified under Section 12 of the solicitation. Refer to the attached Solicitation for the specific evaluation criteria. Offerors are advised to include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items, with its offer. Refer to attached solicitation for further details. The clause at 52.212-4, Contract Terms and Conditions-Commercial Items, applies to this acquisition. Refer to attached solicitation for further details. The clause at 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition. Refer to attached solicitation for further details. Please read the attached solicitation carefully and prepare your proposal in accordance with the solicitation requirements. It is the Offeror's responsibility to submit all questions and proposals by the scheduled closing date and times, in accordance with the "Instructions to Offerors". Please note that the deadline for questions is August 14, 2012 by 2:00 PM Eastern Time. All questions must be submitted via email. All responses will be posted on the Federal Business Opportunities website. This RFP does not commit the Government to pay any costs for the preparation and submission of your proposal. It is also brought to your attention that the Contracting Officer is the only individual who can legally commit the Government to the expenditure of public funds in connection with the proposed requirement. The Government reserves the right to award a contract without discussions if the Contracting Officer determines that the initial offer(s) is /are providing the best value and discussions are not necessary. It is the Offeror's responsibility to monitor the FEDBIZOPPS website for the release of any amendments to this solicitation. No telephone or faxed requests for the solicitation will be accepted.
