Description
JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION SGE500-12-C-0038 US American Embassy, Abidjan, Cote d'Ivoire Furnish and Deliver to Site two (2) 200 Ton Air Cooled Chillers 1. OBO/CFSM/FAC/PS on behalf of the US Embassy Abidjan, Cote d'Ivoire is conducting this time sensitive and emergency acquisition for immediate rental to site two (2) air cooled chillers to provide backup cooling for the entire Chancery. The estimated cost for the rental of these two (2) chillers for a period not to exceed six (6) months is $600,000.00 USD. 2. Nature and/or description of the action being approved. New contract action to acquire and deliver procurement, manufacturing and logistic services to rent and deliver to site a two (2) complete 200 ton chiller systems, per USG furnished equipment specifications. Services shall include procurement and logistics, material delivery to site and complete physical plant and hardware. These rental chillers are required to afford Post with enough time to procure a new 400 ton chiller and to support and conduct Mission functions, including those functions related to National Security.. 3. A description of the supplies or services required to meet the Department's needs. Furnish and delivery to US Embassy Abidjan, Cote d'Ivoire, two (2) 200 ton rental chillers to provide complete backup emergency cooling. 4. An identification of the statutory authority permitting other than full and open competition. In accordance with 41 U.S.C. 3304(a)(1) (formerly 41 U.S.C. 253(c)(1), only one responsible source and no other supplies or services will satisfy agency requirements. 5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. Due to the unusual compelling and field expedient nature of this requirement to maintain and sustain functional classified access areas and office spaces, these rental chillers are required in order to protect and safeguard Mission personnel and operational functions from attack failure. 6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. Due to the sensitive nature and timing of this requirement, a sole source procurement is being initiated. OBO/FAC talked to several vendors, but due to the electrical requirements only one vendor could supply the chillers that we specified. Carrier Rental Systems Ltd could have the chillers at post and up and running in three (3) days once the contact is awarded. 7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. As per FAR 15.403-5 (2), the offer, dated: May 10, 2012 fulfills the requirement for requesting other than certified cost or pricing data. Mr. Willie M. Rhodes, Mechanical Engineer for OBO, is overseeing this project from the OBO Office in Washington D.C. Mr. Rhodes has over 21 years of experience and training in the field of Mechanical Engineering. Mr. Rhodes finds the Vendors Price to be in-line with HVAC (Cooling) Industry Standards and Pricing and therefore fair and reasonable. The offeror had no reason to believe that other potential offerors did not intend to submit an offer. 8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted. OBO conducted a market survey and contacted two other vendors to determine their capability to supply and install this equipment in a timely manner. Carrier can have the chillers on the ground and up and running within three (3) days after the contact is awarded. 9. Any other facts supporting the use of other than full and open competition. Currently, Post's has two (2) 400 ton water cooled chillers. One of these 400 ton chillers has completely failed. The other chiller needs major repair and maintenance. This cannot take place until these rental chillers arrive on site and are up and running as there remains a probability the chiller cannot be repaired. Post requires two functional 400-Ton chillers and thus the urgency of having a reliable unit at Post now. These rental chillers will also allow OBO/CFSM/FAC/PS enough time to procure a new 400 ton chiller and have it installed. 10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. Include a statement that this J&A for other than full and open competition will be published on FedBizOpps in accordance with FAR Section 6.305 within 14 days of award (or within 30 days if the J&A is for unusual and compelling urgency.) Due to the sensitive nature and timing of this requirement, a sole source procurement is being initiated. This J&A for other than full and open competition will be published on FedBizOpps in accordance with FAR Section 6.305 (b) within 30 days of award.
