Description
This is a combined synopsis/solicitation notice of intent for commercial items prepared in accordance with the format in Far Part 12.6, as supplemented with additional information included in this notice. NCEZID/DHCPP/Viral Special Pathogens Branch intends to procure on a sole source basis from PerkinElmer Health Sciences, Inc., Shelton, CT 06484-4794, a contract agreement for the Operetta Instrument Configuration (Qty-1) : Harmony Machine Learning License and installation. The contractor will provide the following instrument, parts, and installation: HH12000000 Opertta Configuration ( The basic wide field fluorescence system.); HH12000704 Harmony Machine Learning License; HH10910020 Operetta Installation; and Regular delivery expenses. This announcement constitutes the only solicitation; a quote is being requested and a written solicitation will not be issued. Justification for other than full and open competition is considered due to the fact that PerkinElmer is the manufacturer which has the proprietary rights and is the sole firm to provide this instrument and it's proper installation. Only One Responsible Source and No Other Supplies or Services will satisfy agency requirements. Note 22 applies herein. The statutory authority permitting other-than-full-and-open competition is 41 U.S.C., 253(c)(1): FAR 8.404-6(f). The incorporated provisions and clauses are the ones for commercial items. This acquisition will not be processed under Simplified Acquisition Procedures and is not a small business set-aside. The North American Industry Classification System Code (NAICS) for this acquisition is 334516, and the small business size is 500 employees. The following factors are being considered for this requirement (1) price, (2) warranty, and (3) technical capability to meet requirement specifications. Place of delivery CDC, Atlanta, Georgia. The government will award a firm fixed-price purchase order to the responsible contractor, and the FOB term are "Destination" and Net 30. FAR provisions and clauses that apply to this acquisition: FAR 52.212-1, Instructions to Offerors, Commercial Items; FAR52.212-2 Evaluation-Commercial Items; FAR 52.212-3, Offeror Representations and Certifications-Commercial Items; FAR 52-212-4 Contract Terms and Conditions Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders, Commercial Items; FAR 52.204-7, Central Contractor Registration; and FAR 32.703-2, Availability of Funds, FAR 52.232-34, Payment by Electronic Funds Transfer-Other than Central Contractor Registration. In order to be considered for an award, an offeror must have completed the online electronic Representations and Certifications located at http://orca.bpn.gov/ in accordance with FAR 4.1201(a). By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the CCR at www.ccr.gov/ prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation [Note: Lack of registration in the Central Contractor Registration will make an offeror ineligible for award.] Offers must be submitted no later than 5:00 P.M.
