- Justification This is posted as notification of the Government's intent to enter into sole-source award under the authority of FAR 6.302-1: "Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements". This announcement is published for informational purpose only. THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS. Request for copies of a solicitation in response to this notice will not be honored or acknowledged. Any responsible source who believes it is capable of meeting the requirement many submit a capability statement. Companies that can provide an equal item must submit their technical capabilities to include complete and detailed specifications. This information will be reviewed by the Government technical representative for consideration for future requirements. A determination by the Government not to compete this proposed action based upon responses to this notice is solely within the discretion of the Government. USDA Forest Service intends to award on a sole source basis under the statutory authority permitting other than full and open competition 10 U.S.C. 2304(c) (1), as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Service will Satisfy Agency Requirements; for the procurement and delivery of CodeBaby Annual Maintenance Support. This annual maintenance support is to continue to support the continued effective operation of CodeBaby software, for the Government to know longer support the software it current is implementing and move to another type of animated e-learning tool will cause undue finical burden to the Government and explaining and determination is cited in the attached justification. The Government intends to solicit and award a sole source contract for Annual Maintenance Support for CODEBABY animated e-learning software to Code Baby Corp., 111 S. Tejon St., STE 204, Colorado Springs, CO 80903.
