- COMBINED SYNOPSIS/SOLICITATION FIVE YEAR BLANKET PURCHASE AGREEMENT (BPA) FOR HYDROGEN AND HELIUM PURCHASE FOR THE NATIONAL WEATHER SERVICE (NWS) WFO AT PEACHTREE, GA (I) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice and in accordance with the simplified acquisition procedures authorized in FAR Part 13. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (II) This solicitation is issued as a request for quotation (RFQ). Submit written quotes on RFQ Number is NWWP4492HYDROGEN (formerly NWWP9219-12-04492SRG). (III) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-¬¬60. (IV) This solicitation is being issued as a Total Small Business Set-Aside. The associated NAICS code is 325120. The business size standard is 1,000 employees. (V) This combined solicitation/synopsis is for purchase of the following commercial products: CLIN 0001 - FIVE YEAR BLANKET PURCHASE AGREEMENT (BPA) FOR HYDROGEN AND HELIUM PURCHASES FOR THE NATIONAL WEATHER SERVICE WFO AT PEACHTREE, GA. THE BPA WILL BE FOR FIVE YEARS WITH A NOT-TO-EXCEED $3,000.00 PER DELIVERY AND A NOT-TO-EXCEED $150,000.00 FOR THE FIVE YEARS. (VI) Description of requirements is as follows: CLIN 0001 - HYDROGEN AND HELIUM DELIVERED ON AN "AS NEEDED BASIS" INCLUDING DEMURRAGE CHARGES. a. PROVIDE DUN & BRADSTREET # ____________________ b. THE SUPPLIER WILL MAKE EMERGENCY DELIVERIES IF REQUESTED BY THIS OFFICE AUTHORIZED WITHIN TWO BUSINESS DAYS OF RECEIVING THE ORDER. c. MUST BE AUTHORIZED RESELLER OF HYDROGEN AND/OR PROVIDE WHO YOUR PROVIDER IS FROM THE BLM AUTHORIZED LIST FOR THE HELIUM. d. PROVIDE RATES FOR FIRST YEAR OF BPA. e. BACKGROUND - THE NATIONAL WEATHER SERVICE (NWS), FFC WFO (WFO) USES HYDROGEN, SIZE 200 CGA 350 CANISTERS, TO INFLATE WEATHER BALLOONS LAUNCHED TWICE PER DAY, EVERY DAY, AND ON OCCASION THIS OFFICE ACCOMPLISHES UP TO 4 LAUNCHES A DAY DURING PARTICULAR WEATHER SITUATIONS SUCH AS DURING HURRICANE SEASON. APPROXIMATELY 1 CYLINDER A DAY IS USED DURING NORMAL OPERATIONS AND UP TO TWO DURING MORE ACTIVE WEATHER. IT IS ESSENTIAL TO HAVE AN ADEQUATE SUPPLY OF HYDROGEN ON STATION FOR THE BALLOON LAUNCH PROGRAM. THE NWS HAS IN THE PAST HAS HAD A STANDING ORDER TO HAVE 12 CANNISTERS ON HAND AT THE END OF THE REGULARLY SCHEDULED THURSDAY DELIVERY. IF IT IS DETERMINED THAT AN ADDITIONAL HYDROGEN DELIVERY IS NEEDED, A TELEPHONE CALL WILL BE PLACED TO THE SUPPLIER, ORDERING THE NUMBER OF ADDITIONAL CANNISTERS AT THAT TIME. IF THE HYDROGEN MARKET RATES ADJUST IN PRICE, THE AUTHORIZED GOVERNMENT BUYER MUST BE INFORMED OF THE CHANGE IN RATE VIA EMAIL OR THROUGH THE ORDERING PHONE CALL BEFORE THE ORDER IS FULFILLED. f. HELIUM: INTERMITTANTLY THIS OFFICE MAY REQUIRE ONE 100 CGA CANNISTER OF HELIUM USED FOR PUBLIC EVENTS. THIS OFFICE WILL ALERT THE COMPANY TO SUCH A NEED ON AN "AS NEEDED BASIS". INVOICING: THE CONTRACTOR WILL PROVIDE A PROPER INVOICE AT THE TIME OF DELIVERY OR SENT TO THE BELOW ADDRESS IN ARREARS. THE INVOICE WILL BE PAID IN ACCORDANCE WITH THE PROMPT PAYMENT ACT. IMPROPER INVOICES WILL BE RETURNED AND PAYMENT WILL NOT BE MADE UNTIL RECEIPT OF A PROPER INVOICE. "Federal hydrogen supplier" means a private hydrogen vendor that has an in-kind crude hydrogen sales contract with the Bureau of Land Management (BLM) and that is on the BLM Amarillo Field Office's Authorized List of Federal Hydrogen Suppliers available via the Internet at http://www.nm.blm.gov/www/amfo/amfo_home.html. "Major hydrogen requirement" means an estimated refined hydrogen requirement greater than 200,000 standard cubic feet (scf) (measured at 14.7 pounds per square inch absolute pressure and 70 degrees Fahrenheit temperature) of gaseous hydrogen or 7510 liters of liquid hydrogen delivered to a hydrogen use location per year. (b) Requirements- (1) Contractors must purchase major hydrogen requirements from Federal hydrogen suppliers, to the extent that supplies are available. (2) The Contractor shall provide to the Contracting Officer the following data within 10 days after the Contractor or subcontractor receives a delivery of hydrogen from a Federal hydrogen supplier- (i) The name of the supplier; (ii) The amount of hydrogen purchased; (iii) The delivery date(s); and (iv) The location where the hydrogen was used. (c) Subcontracts. The Contractor shall insert this clause, including this paragraph (c), in any subcontract or order that involves a major hydrogen requirement. (End of clause) Department of Commerce Clauses: 1352.201-70, Contracting Officer's Authority (Apr. 2010). The Contracting Officer is the only person authorized to make or approve any changes in any of the requirements of this contract, and, notwithstanding any provisions contained elsewhere in this contract, the said authority remains solely in the Contracting Officer. In the event the contractor makes any changes at the direction of any person other than the Contracting Officer, the change will be considered to have been made without authority and no adjustment will be made in the contract terms and conditions, including price. (End of clause) 1352.209-73 COMPLIANCE WITH THE LAWS (APR 2010) The contractor shall comply with all applicable laws, rules and regulations which deal with or relate to performance in accord with the terms of the contract. (End of clause) Representation by Corporations Regarding an Unpaid Delinquent Tax Liability or a Felony Conviction Under Any Federal Law (Class Deviation) (March 2012) (1) In accordance with Sections 543 and 544 of Public Law 112-55 Commerce, Justice, Science, and Related Agencies Appropriations Act 2012, Title V (General Provisions) none of the funds made available by that Act may be used to enter into a contract with any corporation that- (a) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, unless the agency has considered suspension or debarment of the corporation and made a determination that this further action is not necessary to protect the interests of the Government. (b) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, unless the agency has considered suspension or debarment of the corporation and made a determination that this further action is not necessary to protect the interests of the Government.
